A vehicle has a title like a home. If you have an item you had before the marriage. You cherished it for years. It’s in your name. It’s titled to you. Later on, there’s a divorce. Your spouse tries to get it from you. Will your spouse likely get it? The answer is probably no.
*Property titles in divorce are akin to those of real estate. *Items owned before marriage, especially if titled in your name, typically remain with you. They are separate property. *Courts recognize assets acquired before marriage and often rule in favor of the original owner. *Ownership isn't solely dictated by the title; prior acquisition matters. *Assets acquired during marriage, even if titled to a spouse, can still be subject to division in divorce. They are classified as marital assets. *While you may not physically split an asset, its value can be divided during divorce proceedings. It applies to both home and cars.
During the whole divorce process, you will learn certain assets are marital and some separate. In the end, you must realize that Michigan family laws subscribe to fair and equitable distribution of assets. Expect fairness but no more than the law can offer.
