• A simple phone call or consultation does not automatically disqualify a lawyer from representing your spouse. • The key factor that creates a conflict is the exchange of confidential information, not whether the consultation was paid or free. • Public information, such as the fact that you are married or have children, does not count as confidential. • A judge will not automatically remove an attorney; a motion to disqualify must be filed, and you must prove that sensitive information was shared. • While disqualifying a lawyer can cause delays, it rarely changes the ultimate outcome of the case, as your spouse will simply hire new counsel.
