If your ex-spouse loses their job, their alimony obligation does not automatically stop. A formal court process must be initiated to modify the existing alimony order based on the change in circumstances.
• Alimony continues until a further order of the court; a job loss does not grant permission to stop paying. • To modify payments, the payer must demonstrate a significant financial change to the court, such as a substantial salary reduction or termination of employment. • The court does not automatically reduce alimony; the person paying must file a motion to request a hearing. • Any changes granted by the court are typically only retroactive to the date the motion was filed, not the date of the job loss. • It is the responsibility of the person paying alimony to go to court and request a reduction as soon as possible to avoid accumulating debt.
