I’m lawyer Fabio Loscerbo. A recent Italian administrative court decision makes one point very clear:
when an expulsion order is annulled, only the SIS alert linked to that specific order must be deleted. Other SIS alerts, for example those based on criminal convictions, remain valid if their legal basis still exists. This distinction is crucial in practice.
