    Carl's  journey includes a lengthy, expensive, high-conflict divorce and CUSTODY BATTLE that was entirely UNNECESSARY. What he learned was that the system, and less so his ex, was to blame. The SYSTEM placed their CHILDREN in the middle and pitted Carl and his ex against one another for no one's benefit except the lawyers. And, courts ALLOWED it to happen.
     The inspiration and passion for SplitSmart.com comes from that brutal experience. Carl explains that his goal is to organize divorcing couples so that they can avoid a similar fate.   Slam the Gavel welcomes Joslyn Wolfe  to the podcast. Mother of two daughters, one, 23, who has been painfully alienated from Joslyn since she was 15, as her father stated when they parted that, "it would be worth it to see you suffer," and another daughter, 18.   
      Joslyn is a by-product of an indifferent Family Court, the Cruel Purveyors of Family Disintegration. Parental Alienation as demonstrated in the case with the eldest daughter, Joslyn has concerns and is never notified of any medical emergency visits or doctors appointments.
      Joslyn is a Graduate of Goucher College, and attended The Johns Hopkins University. She is also a Global Goodwill Ambassador. Also an Awardee SHE Economy Conference in Bangladesh and Presenter on How fake News Erodes the Social Fabric, Joslyn is a Recipient of various Journalism Fellowships and Civic Awards.  
    Former Commissioner with the Women's Commission in my residence state of Maryland, Joslyn is a survivor of Domestic Violence as acted out through vexatious litigation, triangulation of the children and Coercive Control.   
     Author of a Children's book, Playright, and creator of Circle Sacs by J and Company, TM, she is also a Publisher of Focus on Women Magazine,  Intern Supervisor to students interested in Journalism.
    Joslyn has been instrumental in getting legislation passed in her state and signed into law by the Governor, which is now  a Case Study in a High School Civics textbook.      
     Recently, in 2021,  Joslyn gave testimony on behalf of a Domestic Violence Bill that would require most parties of the court to report abuse and neglect in cases of Domestic Violence.  
    We discussed the destructive elements of COERCIVE CONTROL post DIVORCE. Divorcing a PERSONALITY DISORDER is not easy to do. Joslyn gave great advice regarding how to handle specific situations and if you hire a lawyer that you feel is not working for you, fire them, you will be better off in the long run, even if it is at mid-trial.

     Slam the Gavel welcomes back Supreme Court Attorney, T. Matthew Phillips. Attorney Phillips was last on the podcast Season 3, Episodes 137 and 152. We discussed this brilliant, unique and one- of-a-kind CLASS ACTION LAWSUIT that is including ELEVEN families.
     The named Defendant is the Judicial Council of California, which is the policy making body that trains judges. The Plaintiffs are arguing that there is no Constitution in the California state court system, particularly in the "Family Court." They don't recognize that the Constitution exists and yet the Constitution  is supposed to be the SUPREME LAW OF THE LAND. The judges and  the Attorneys are not arguing the Constitution.
     Attorney Phillip's Clients are arguing that Parenting is a fundamental right and Constitutional right that is protected under the 14th Amendment. They believe the judges in California NEED TO BE TRAINED in this and need to know and understand that PARENTING is a FUNDAMENTAL RIGHT. They can't take away custody and parenting time unless a parent is actually found UNFIT with ACTUAL EVIDENCE found in a fitness hearing not in a divorce proceeding. 
     The parents contend that they are having their FIRST and FOURTEENTH AMENDMENTS violated. In the FIRST AMENDMENT, it protects FAMILIAL ASSOCIATION, the right to association and private speech. The FOURTEENTH AMENDMENT, protects the RIGHT TO PARENT. However, parents are being ROBBED of PRIVATE SPEECH with their children, especially in SUPERVISED VISITS. The GOVERNMENT is in control and LISTENING and it's a HUGE  VIOLATION of the  FIRST AMENDMENT right to familial association.
     Parents involved in custodial rights are getting their children taken away based on standards that fall below the minimum Constitutional standard. Once the CONSTITUTIONAL STANDARD drops below the minimum, they believe the federal government should get involved to protect these federally protected civil rights.
    This is a different lawsuit as they are not suing judges; they are suing the Judicial Council. The judges are not recognizing the Constitutional Parameter and the judges are just exercising arbitrary discretion.....

Lisa, now a Childhood Trauma Educator,  was alienated from her mother by her stepmother for FORTY YEARS.  Her story is one of the most well-known documented cases of CHILD ALIENATION in the WORLD. Lisa's ability  to connect and help others UNDERSTAND the DANGERS of not Co-Parenting and the CONNECTION to PARENTAL ALIENATION is creating a positive and constructive movement forward to HELP CREATE CHANGE while clearing the PATH for other survivors to COME FORWARD.

We discussed how and why step parents won't step back and the anger in an alienated child as well as adults who are just waking up to the fact that they had been alienated from a beloved parent.

Slam the Gavel welcomes back Kenneth Vignali, Founder Of Signature Peace Of Mind, to the podcast. Kenneth was last on the podcast Season 4, Episodes 39, 85 and 104.
    Signature Peace Of Mind helps victims with cyber security issues. Kenneth talked about how he joined International Association Of Privacy Professionals. They have been an industry group for many years. It's an organization that tracks and provides updates and they advocate for different privacy related legislation around the world and training. Like a lot of industry groups, they have sub groups and  Kenneth can consult with them on cases he is involved in.
    We talked about AI and explained how imagery on social media that can be manipulated and leveraged to put people in bad situations. Kenneth talked about providing parents with tools, education and awareness. 
    There is help out there and conversations that can happen. Parents, children and their friends can have conversations that can disappear so quickly on Snapchat. Kenneth talked about the mobile app Canopy.us, a mobile app and explained that, "you can give your kids some freedom, but Canopy.us looks at the photo and if it thinks it's too explicit in nature, it gives another layer of control for the parent who has the mobile app on their phone or computer and sends out an alert." 
    We also discussed Selena's case which has been ongoing for two years and she has not reenable to see her 11 year- old daughter since June,  Season 4, Episode 104. Toward the end of the summer the case was wrapped up. The Malicious Prosecution was dropped to a misdemeanor. So she is free to move where she wants. She should have been EXONERATED. In regards to her daughter, she is still fighting to see her. Kenneth has tried to talk to the Senator in Texas. However, there are people in positions of power with no OVERSIGHT. This all stemmed from family members of hers that took advantage and there was a key law enforcement officer that took it upon himself to give the child to the biological father. She has trying to leverage any legal means necessary. This mother has done everything right as she has sole custody, however there is collusion between CPS, Law Enforcement and Schools. They have power with no recourse. There was no court order signed saying that she can't see or have her daughter back. This is a power-hungry school system along with CPS.

   Slam the Gavel welcomes Carmela Martinez to the Podcast.  Carmela is 58 years old living in New York State. She has been dealing with the family court and child support court for over 10 years
    Carmela was told by her ex-husband that she “breached my side of the marriage contract” when she wanted to start a family.  After the tirade of x, they both agreed to start a family. 
     However, the ex-husband wouldn’t allow Carmela to work part-time against her pleas, once children were born. She was always self-supporting. The boys and she wanted for nothing. Their lives looked like a postcard to the outside world! But inside, the boys and their MOTHER were subjected to her ex's demonic rage on a daily basis. 
    Carmella did it until she couldn’t do it anymore. It took her 3 years to find the courage and strength to file for divorce. She was terrified the day he would be served, which was the  Friday of memorial weekend 2015. She planned for both boys to have sleepovers. Her therapist urged her to get herself and other dog out of the home before the ex-husband appeared. 
     The beginning of the nightmare would NOW begin. From the onset he used their eldest as his PAWN! Her children were ages 12 and 9 when Carmela filed. The SCHOOL suggested that she allow her eldest to live with the ex-husband temporarily. 
      Things had become explosive and the eldest was confused and angry as the ex-husband fueled that confusion and anger, churning Stockholm Syndrome and Parental Alienation. The eldest was acting out horrifically. 
     What was supposed to be "temporary" stay, ended up being 6 months during the arduous month after month of the forensic psychiatry report to be completed. The renowned "Dr. M," told Carmela “as long as these children are minors, he will never coparent with you!” Little did she know what those words would really mean!

     We discussed the frustration with the school systems for many parents including NON-CUSTODIAL parents. We also discussed what can happen when false allegations are involved and how poorly a parent is treated when the CUSTODIAL parent files the Custody paperwork while influencing and manipulating the the school staff against the NON-CUSTODIAL parent. 
    Darlene and Dolores gave advice on how to handle all sorts of situations and how parents should know their FERPA rights. Dolores, Darlene and myself gave examples including what really should be done when CPS enters the building and wants to speak to YOUR child. Your child should tell the CPS caseworker that they will not speak to them until they have their own attorney present. Much more advice followed regarding how the school systems and the family court system resembles each other. Not a podcast to be missed.

    Slam the Gavel welcomes back Elaine Mickman, Author of, "Court Gate...The Court$ Divorced From The Law," available on Amazon, FREE  in eBook this October 12th - 14th, 2023 and for several days after. Elaine was last on the show on Season 3, Episode 20 and 30. 
     Elaine updated her case, saying that there is not much movement.  However, Elaine gave the history of her case.
       The tactics state and federal courts use on litigants such as tampering with the COMPUTER SYSTEM, "quashing" a case without a legitimate reason and dismissing the case, saying they were never "served." We talked about e-filing and that there are many ways that can be tampered with as well. A first level appeal is a RIGHT, promised in the Constitution. Yet they block people. "They do not rule by law in this unjust system," Elaine states. They are trying to predetermine if a person can appeal by a new tactic called "Summary Action." IT NEVER ENDS.
     We talked about legislative law. In Pennsylvania, Article 5. 10(c)  prohibits Judge's abridging a litigant's rights.  The Court has their own rule, 210 PA 63.1 states that the judiciary can't create or diminish rights, yet THEY ARE DOING IT.
    Discussing Diane Diamond's book, "We're Here To Help, When Guardianship Goes Wrong." Elaine talked about how they put a Guardians on  somebody who is getting divorced and would be getting child support or spousal support or divorce settlement, most of the time exparte happens and they sign away your assets and the person has no rights. Then take the Guardian off, and the person is left destitute, homeless and broke. 
     There is no oversight for the Supreme Court. HR288 is looking for accountability and oversight in the US Supreme Court. There needs to be an independent agency. You can't have a judge overseeing another judge. They have dismissed 99% of the complaints filed by litigants. 
     Elaine recommends that if you can avoid the court system do it. If you are able to negotiate with the other party, do it.

    Slam the Gavel welcomes Dawn Wolfson to the podcast. Dawn Wolfson was already a follower of the work being done by the Innocence Project when her own family was hit by a FALSE ACCUSATION four years ago. A family member who was about to start his senior year of High School - he was a SPECIAL EDUCATION student - met a girl through a mutual friend. During a sleepover, they had relations, and for reasons the family may NEVER know, she ACCUSED him of rape. 
     From the start he did everything wrong by trying to contact her online to find out what was going on, apologizing on a text and didn't tell family members until after he was questioned at his school by law enforcement.
     This was the beginning of an eye opening 2.5 year journey through the legal system. However the family was one of the lucky ones where they had retirement savings and found a great lawyer who also knew a very motivated investigator. He then tracked down enough witnesses to create doubt on the accuser's story. The DA dropped the charges.
     However, shortly after the charges were dropped, Dawn met a man who was involved in NCFM (an organization that is involved in fighting false accusations against men). He had gotten Dawn involved in the NCFM women's group -  which had spun off into a new organization of fighting false accusations called Advocates Against the Falsely Accused and another group, D3: Decriminalize Developmental Disabilities (formerly LRIDD) that is fighting for changes to how the legal system treats people with intellectual and developmental disabilities.
    Dawn talked about recent reforms such as California and Illinois law prohibiting DECEPTIVE LAW ENFORCEMENT INTERROGATION ON MINORS, and a similar Pennsylvania law prohibiting the same practices on the developmentally disabled. This gives Dawn hope that CHANGE IS POSSIBLE. Dawn sees that the legal system makes it too easy to falsely accuse someone and far too difficult to ESCAPE the legal system.
