The Rome Police Headquarters had declared the application inadmissible because the residence contract signed at the Immigration One-Stop Office was missing. The applicant argued it was the Prefecture’s fault for not having called him yet. But the Court was clear: without a signed residence contract, no permit can be issued. And if the Prefecture remains inactive, the correct remedy is a ‘silence procedure appeal’, not bypassing the Prefecture and going straight to the Police. In the end: appeal rejected, but legal costs were waived due to delays by the public administration.
