  • Developer: Companies That Sell Accessibility Try to Frame It As Impossible to Understand

Kris shares a clip from a developer @ExpandTheRoom who states, "I think that companies that sell accessibility solutions try to frame accessibility as a black box that's impossible to understand. But I believe the concepts are not that difficult if you take the time to learn them."

Exactly.  She has it 100% right.  Website accessibility isn't as hard as it's made out to be.

  • Most (ADA) Website Accessibility Lawsuits Settle Because Defense is Expensive

Kris Rivenburgh explains why most (ADA) website accessibility litigation ends up being settled. Plaintiffs' lawyers typically offer a settlement amount just low enough to make the defendant/respondent accept the offer and forgo the initial defense of the claim.

  • Unraveling Sales Copy for Automated Website Accessibility "Testing" (Scan)

Kris Rivenburgh removes the salesmanship from sales copy for automated website accessibility "testing".  Testing is an extremely generous term for what amounts to a website accessibility scan.  Also, a scan and audit aren't "combined".  A manual audit is performed and a scan is a helpful tool used by accessibility experts auditing a website to help find issues and reduce incidence of error.  However, even issues flagged by a scan still must be manually reviewed.

  • Preventing Litigation vs. ADA Compliance vs. WCAG Conformance: There's a Difference

Kris differentiates preventing website accessibility litigation (demand letters and lawsuits) vs. an ADA compliant website vs. WCAG conformance.  WCAG 2.1 AA conformance is a best practice for both preventing litigation and ADA compliance, but it usually takes several months to reach full conformance.

In the meantime, it is best to address those accessibility issues that plaintiffs' law firms look for when deciding what entities to initiate litigation against.

  • Why is the Website Accessibility Market so Confusing? (Buying Products, Services for ADA Compliance)

Kris Rivenburgh presents on why it's so difficult to sort through the available products and services for website accessibility (presumably to help with ADA compliance and preventing litigation).  Researching the market is a difficult task in and of itself for many reasons.  One reason is because different sellers are selling different things.

Here is a list of some of the more visible sellers that offer products and services in the website accessibility space:

    AccessiBe

    EqualWeb
    AudioEye
    MicroAssist
    Level Access
    Deque
    UsableNet
    Accessibility.works
    WeCo UserWay
    BOIA Monsido
    TPGI
    Accessible Metrics
    CrownPeak
    AccessibilityOz
    Knowbility
    BarrierBreak
    WebAIM
    SiteImprove
    Hassell Inclusion

There are literally dozens of other organizations that offer website accessibility products and services.

To help understand what each seller is offering, it's best to bucket the different sellers into 5 categories:

    1. automated "solutions": work under the premise of you can make your website accessible/compliant and prevent litigation through an accessibility widget, commonly referred to as an overlay. They don't edit your code or remediate your content and they don't make your website WCAG conformant and they haven't prevented lawsuits.

    2. automated scans & reporting: center around the ability to scan a website and produce reports of the results and progress made. Maintenance and monitoring with alerts are a part of the product but manual service work is avoided.

    3. mid-tier agency audits: primarily offer a manual accessibility audit and consultation. Limited in capacity as they are typically small businesses.

    4. user testing services: offer actual user testing from professionals with disabilities along with support. Usually small business/agency types or non-profits.

    5. enterprise level packages: large company with at least 15 employees and a sales team. Primarily deal with larger organizations (e.g., government agencies, well known corporations). They feature a manual audit along with a suite of additional products and services including training and support.

Review sites also contribute to the confusion.  Review sites include:

    AccessibilityChecker.org

    WhoisAccessible.com
    G2.com Capterra.com
    Ddiy.co
    GetApp.com
    TrustPilot.com
    WebsitePlanet.com
    SoftwareAdvice.com
    BestWebsiteAccessibility.com
    CrozDesk.com
    HostAdvice.com
    WPLift.com

Almost all of the review sites that rank in Google distort reality with favorable write-ups on overlay widgets alongside more tepid write-ups of genuine accessibility service providers.

  • Can You Get Sued for ADA Compliance While Working on Website Accessibility (Remediation)?

Kris answers a LinkedIn message that asks about the risk of being sued while working on website accessibility.

ADA Compliance for websites is a gray area, but for practical purposes, think of the Americans with Disabilities Act in terms of absolutes: either you're in compliance or you're not.

  • Best Website Accessibility Software: WAVE Automated Scan Tool (Free and Easy to Use)

Kris gives a brief demo using the WAVE scan tool to show why WAVE is the best website accessibility software.  WAVE is simple, intuitive, and easy to use for anybody.  And it's completely free for single page scans.

Kris also explains that there is no software that automatically make your website accessible.  You may come across "automated solutions" that are referred to as overlays, widgets, plugins, apps, toolbars, etc.  These overlays do not make your website accessible.

Note that the WAVE scan (sometimes called an ADA compliance checker) is an incomplete scan in that a manual review is required for issues that are flagged and the scan cannot detect all accessibility issues.

WAVE is make available by WebAIM, a reputable organization that offers website accessibility services and training.

You can access WAVE at https://wave.webaim.org.
