Appleby Bermuda Shorts | Tech Talks S01 E13
In our latest “Tech Talks” podcast, Appleby Bermuda partners Jerome Wilson (Head of Technology & Innovation), Vanessa Schrum (Head of Private Client & Trusts) and Hannah Tildesley (Head of Trusts Disputes) dive into the world of digital assets as they relate to trusts.
The trio look at digital assets from two angles - first from the consumer perspective and how you can estate plan if you hold crypto or have other digital assets. What are some of the things you need to keep in mind as you plan for your estate and want to have succession of the assets.
Second, they discuss from a trustee perspective, both as trustee as an individual, and as a trustee that is a professional services company. What things do you need to keep in mind as you provide services to the trust.
When it comes to digital assets, it’s important to understand what they are, where they are and how they can be accessed. Although bitcoin is the most well-known digital asset, there’s numerous types of digital assets that have monetary value – such as airmiles, loyalty points, PayPal, online businesses, gaming accounts and many others. There are also digital assets that have sentimental value - such as blogs and social media accounts. It’s important to understand and plan in advance what is going to happen with all these assets, and not just to your crypto. That’s where digital estate planning comes in.

Emerging challenges in digital assets continue to push the courts to develop their thoughts on historic concepts as they examine how best to catch up with this new asset class.
Bermuda Partners Jerome Wilson and Hannah Tildesley dive back into the exciting space of digital assets in the courts in the latest ‘Tech Talk’ podcast, which is a continuation of episode 7 where they examined several cases and the issues facing the courts around the world.
In this episode the pair consider how to accommodate an asset class that doesn’t neatly fit into the existing ideas of assets, fiduciaries or individuals, and discuss recent cases where the courts have begun to shift their approach. Listen to learn more about this exciting space where the law is changing before our eyes in order to catch up with this new asset class to deal with the very real issues being raised – valuable information whether you’re on the business or consumer side.
Jerome and Hannah also share that in this time without clear direction on some of the issues, people need to be careful with their keys and who they give access to their crypto. Some of the recent cases are going to raise really interesting duties because if the developers of the bitcoin chains and the bitcoin software owe duties - then you start to wonder about crypto exchanges, companies providing wallets - and basically anyone providing crypto services.

Personal Information Protection Act (PIPA) – what do Bermuda companies need to know to be ready?
Listen as Jerome Wilson, Partner and Head of Bermuda’s Technology & Innovation practice talks to fellow Partner Duncan Card, who specializes in privacy law, cybersecurity compliance and IT and outsourcing contracts – as they discuss recent indications that PIPA may come into full force this spring - possibly on a sectorial basis.
As a result of the many rights that PIPA bestows on individuals, organisations must ensure that all of their business processes, customer relations programmes, data management systems and administrative processes are compliant with the practices, protections, and use restrictions that PIPA will soon impose on them.
Jerome and Duncan also discuss the important distinction between the “Privacy Notice” that is required by PIPA, and the “Privacy Policy” that requires organisations to adopt suitable measures and policies to give effect to all of their obligations, and to the rights of individuals, as set out in PIPA.
