• NH Supreme Court upholds topless Ordinance 3-2
• • On appeal, the defendants argue that the trial court erred by denying their motion to dismiss because the ordinance: (1) violates their right to equal protection under the State and Federal Constitutions; (2) violates their rights to free speech and expression under the State and Federal Constitutions; (3) does not fall within the regulatory authority granted to the City of Laconia by the legislature; (4) is preempted by RSA 645:1; and (5) violates RSA chapter 354-A.
  • Associate Justice, Bobbie Hantz Marconi wrote for the majority who affirmed the Circuit Court’s ruling on all counts, Chief Justice C.J. Lynn and Associate Justice Patrick Donovan concurred
  • • “We conclude that the Laconia ordinance does not classify on the basis of gender. The ordinance prohibits both men and women from being nude in a public place….That the ordinance defines nudity to include exposure of the female but not male breast does not mean that it classifies based upon a suspect class. ...The ordinance merely reflects the fact that men and women are not fungible with respect to the traditional understanding of what constitutes nudity.”
    • ”Applying the standard, we have little trouble concluding that the defendants have not carried the heavy burden of mounting a successful facial attack to an ordinance analyzed only for rationality. The stated purpose of the ordinance is to uphold and support “public health, public safety, morals and public order.” “
    • “The dissent faults us for seeking guidance from other courts in ascertaining whether Laconia’s ordinance classifies based on gender. However, as demonstrated by the lack of any meaningful discussion of our precedent in the dissent, we have little in the way of help from our own cases in answering this question.”
    • Although there exists no express authority for a city to enact an
      ordinance prohibiting females from exposing their nipples, RSA 47:17, VII
      (2012) grants the city the power “[t]o regulate all streets and public ways,
      wharves, docks, and squares, and the use thereof.” Further, RSA 47:17, XIII (2012) grants the city the power “to regulate the times and places of bathing and swimming in the canals, rivers and other waters of the city, and the clothing to be worn by bathers and swimmers.” In addition, RSA 47:17, XV (2012) gives the city the power to “make any other bylaws and regulations which may seem for the well-being of the city” so long as “no bylaw or ordinance” is “repugnant to the constitution or laws of the state.”
  • Justice James Bassett wrote for the dissent, who concurred in part and dissented in part, Justice Hicks joined
  • • We agree with our colleagues in most respects: Laconia’s ordinance does not violate the defendants’ rights to freedom of speech and expression; it falls within the regulatory authority of the City of Laconia; it is not preempted by statute; and it does not violate RSA chapter 354-A. However, we part company with the majority when it rejects the defendants’ equal protection claim. We strongly disagree that rational basis is the lens through which the defendants’ equal protection challenge should be analyzed. Laconia’s ordinance facially classifies on the basis of gender: if a woman and a man wear the exact same clothing on the beach, on Laconia’s main street, or in a backyard “visible to the public,” the woman is engaging in unlawful behavior — but the man is not.
    • The majority acknowledges — as it must — that under the New Hampshire Constitution, gender-based classifications trigger strict scrutiny. Yet the majority declines to apply strict scrutiny in this case, reasoning that, because “men and women are not fungible with respect to the traditional understanding of what constitutes nudity,” the Laconia ordinance does not classify on the basis of gender. The conclusion that the ordinance does not classify on the basis of gender, and therefore can be analyzed by applying the rational basis test, does not find support in the plain language of the ordinance, the New Hampshire Constitution, or our precedent.
    • That the ordinance classifies on the basis of gender is self-evident. The ordinance defines “nudity” differently for females and males. By the plain text of the ordinance, a person who appears in a public place showing “the female breast with less than a fully opaque covering of any part of the nipple” violates the ordinance; a male who appears in the same public place without such a covering does not. Laconia, N.H., Code of Ordinances ch. 180, art. I, §§ 180-2, 180-4 (emphasis added). The challenged portion of the ordinance creates a public dress code which only one gender can violate. This is a gender-based classification.
    • The ordinance’s stated purpose is to uphold and support “public health, public safety, morals and public order.” Laconia, N.H., Code of Ordinances ch. 180, art. I, § 180-1 (1998). In the trial court, the City asserted that because the defendants were topless, they caused a “disturbance” which “has the potential for violence.” The City also asserted that, because people think of “female breasts in a sexualized manner,” topless women may present other beachgoers with “a mental health issue.” Turning to the ordinance’s other stated purposes, “morals and public order,” the City argued to the trial court that women who do not cover their nipples act contrary to “the City’s character” and “morals as determined by the city council.” However we, like the United States Supreme Court, “have never held that moral disapproval, without any other asserted state interest, is a sufficient rationale under the Equal Protection Clause to justify a law that discriminates among groups of persons.”

• The Claremont decision Claremont School District v Governor of New Hampshire
• • 7 important legal cases involving public education
  • Background: Claremont and four other school districts brought forth the suit because they  couldn’t afford to properly fund their public schools based on local property taxes. Original suit in the early 80’s was settled when the State agreed to contribute 8% of the cost of education to target poor school districts.
  • State never fully funded their promise causing Stevens High School in Claremont to lose its accreditation status due to disrepair. (1989)
  • The Claremont II case
  • The Supreme court reversed what the trial court had decided. (1) the education provided in the plaintiff school districts is constitutionally adequate; (2) the New Hampshire system of funding public elementary and secondary education guarantees constitutionally adequate funding to each of the plaintiff school districts; (3) the New Hampshire system of school funding does not violate the plaintiffs' right to equal protection under the State Constitution, part I, articles 1, 2 and 12; and (4) the system of school financing does not violate part II, article 5 of the State Constitution.
  • “We hold that the property tax levied to fund education is, by virtue of the State's duty to provide a constitutionally adequate public education, a State tax and as such is disproportionate and unreasonable in violation of part II, article 5 of the New Hampshire Constitution. Having so decided, we need not reach the plaintiffs' other claims. Accordingly, we reverse.”

  • The court gave until the end of 1998 to get the legislature to enact a constitutional bill that was proportionate.
  • The legislature failed to do so and filed for an extension.
  • Instead of making a property tax rate state wide, which would be constitutional but also very unfavorable politically, the legislature passed laws to have accountability tests for the schools and if they failed then the state would step in.

• Early History Keene
• • Granted a township in 1732 by Massachusetts Governor Jonathan Belcher
  • • Originally named Upper Ashuelot
  • In 1741 NH and Massachusetts settled their boundary dispute and the town was north of the new line
  • • It was a miniature republic, setting its own laws and managed its own political affairs without higher influence.
    • Upper Ashuelot took no part in provincial affairs for 27 years. Most of the Connecticut river valley wasn’t at the general assembly.
  • The first interaction the town had with the province, as it was then, was for the refusal to pay taxes for the support of the minister
  • • From the provincial records 1742: “I am therefore by his Excellency's Command to inform the respective Inhabitants, that it will be very agreable to the Governor that you & each of you, who have been delinquent on that occasion, do forthwith comply with your obligations in regard to the payment of your Ministers, as a contrary behavior will incur his Excellency's displeasure.”
  • In 1747 during King George’s war, part of the French and Indian wars, indigenous americans attacked the village and burnt it down.
  • People started resettling there as early as 1749 but due to the whole boundary issue before Governor Benning Wentworth regranted the town after a petition was gathered.
  • • “Claiming the right to name the town, the governor named it Keene. In his business as merchant at Portsmouth, previous to his appointment as governor, Mr. Wentworth had contracted with an agent of the court of Spain to supply that government with a large quantity of oak timber. To meet the expense involved he borrowed money in London. When he delivered the timber at Cadiz the agent with whom he had made the contract was out of office and the new agent declined to pay. On his voyage home his ship foundered and he was saved with the crew in a boat, to find himself bankrupt. Afterwards he made another voyage to Spain and claimed payment for his timber. Sir Benjamin Keene was then the English minister to Spain, and he used his influence to aid Mr. Wentworth, who, though unsuccessful in his suit, formed a warm friendship for Sir Benjamin, and his gratitude, and his admiration for the man, led him to name this town in his honor

(Also 1759) Benning's nephew John Wentworth became governor as well later on and established an estate in Wolfeboro called Kingswood next to what is now Lake Wentworth. During the 19th century the only way to get to Wolfeboro was via the road, i.e. stagecoach or horse. In 1872 a railroad was opened that branched off from “Sanborn's Station” in Wakefield from the Portsmouth, Great Falls and Conway Railroad. The railroad caused tourism to explode. What was a small village became one of the biggest tourist destinations. The rail line ended right at Lake Winnipesaukee where you could board the steamship Mt. Washington owned by another railroad. • John W. Weeks - dead (April 11, 1860 – July 12, 1926), but affecting NH to this very day.

• Coös County
• • Originally part of Grafton County, Coös was the first county created after US Independence in 1803.
  • The population at that time was only 3,000 people
  • Coös is an Abenaki term for “dwellers in the pine tree place”or “small pines”
  • Coös has 20% of NH’s land area but only 2.3% of its population at 33,055 at the 2010 census.
  • To compare, Derry, NH’s fourth largest town had 33,255 at the 2010 census
  • In the 19th Century logging, pulp and paper were some of the main industries especially in Berlin, which was home to the Brown Paper Company, which actually invented the modern tape measure in 1922.
  • By the early 1900’s tourism was a booming industry, with grand hotels opening such as The Balsam’s in Dixville Notch, home of the first in the nation vote. The Mt. Washington Hotel in Bretton Woods, home of the Bretton Woods Conference we talked about in a previous episode. Mountain View Grand in Whitefield which has a great view of the Presidential Range in the White Mountains. Tourism is the biggest industry to this day
  • Coös County is one of the most consistent bellwether counties in the nation, having supported the president-elect in every election since 1892 besides 1968 and 2004.
  • Makes up the vast majority of NH’s unincorporated places which are townships that have no government and are usually unpopulated year round. (23, rest of NH 2)
  • No, you can’t get away with murder there. The County runs the place with either neighboring towns or state police providing the police force. Day to day stuff like trash collection plowing etc homeowners pay to the nearest town voluntarily. There’s no property tax in unincorporated places
  • Before you think about buying property, though, some of the unincorporated places are in the White Mountain National Forest which is unfortunately owned by the Feds, or in State owned parks. Which means building a home isn’t allowed in those places.

• History of the Death Penalty in NH
  
  Famous capital cases
  
  Ruth Blay, executed in 1768, was the last woman executed in New Hampshire.  She was accused of allegedly killing her stillborn child - a crime that she was exonerated of shortly after her execution.  A play was made about her death and a popular song recognizing her innocence was sung locally in the Portsmouth area for many years.  
  
  Thomas Powers was executed in 1796 for rape.  He was the only African American man ever executed in New Hampshire and the only person ever executed in NH for a crime other than murder.
  
  Past milestones in abolition/reinstatement
  
  New Hampshire has executed 26 people in its history.  The last execution was in 1939.
  
  Howard Long was put to death in July of 1939.  The rope used to hang him is still retained on display in the Belknap County Sheriff's office.
  
  A bill to abolish the death penalty was passed by the House and Senate in 2000.  The bills were vetoed by Governor Jeanne Shaheen.
  
  In 2004, as part of a national campaign to end the death penalty for juvenile offenders, a bill banning the execution of those convicted of killing while under the age of 18 passed the House and Senate.  It was vetoed by Governor Craig Benson. The next year the same bill was reintroduced and passed again. It was signed by Governor John Lynch.
  
  In 2009, an abolition bill passed the House and was then amended in the Senate to create a study commission on the death penalty. Governor Lynch signed that bill and the commission met for a year and issued a report in December 2010.
  
  In April 2018, the House and Senate again voted to abolish the death penalty. Governor Chris Sununu has said he will veto the bill.
  
• New Hampshire "firsts"
  
  For many years, New Hampshire had the most restrictive death penalty in the country.  It applied only in cases of homicide or treason.
  
  In 1834, New Hampshire's Governor Badger was one of the nation's first to call for abolition of the death penalty as part of the gallows movement.
  
• Other interesting facts
  
  New Hampshire still retains a narrow death penalty statute, which only applies in six specific circumstances.
• • 630:1 Capital Murder. –
       I. A person is guilty of capital murder if he knowingly causes the death of:
          (a) A law enforcement officer or a judicial officer acting in the line of duty or when the death is caused as a consequence of or in retaliation for such person's actions in the line of duty;
          (b) Another before, after, while engaged in the commission of, or while attempting to commit kidnapping as that offense is defined in RSA 633:1;
          (c) Another by criminally soliciting a person to cause said death or after having been criminally solicited by another for his personal pecuniary gain;
          (d) Another after being sentenced to life imprisonment without parole pursuant to RSA 630:1-a, III;
          (e) Another before, after, while engaged in the commission of, or while attempting to commit aggravated felonious sexual assault as defined in RSA 632-A:2;
          (f) Another before, after, while engaged in the commission of, or while attempting to commit an offense punishable under RSA 318-B:26, I(a) or (b); or
          (g) Another, who is licensed or privileged to be within an occupied structure, or separately secured or occupied section thereof, before, after, or while in the commission of, or while attempting to commit, burglary as defined in RSA 635:1
• New Hampshire does not currently have a death chamber. In 2010, the Department of Corrections estimated that building an execution chamber would cost about $1.7 million, but the legislature has not authorized funds to build it.

• Alan Shepard, first American in space.
  • Born in Derry, NH in 1923
  • Earned a Bachelor of Science at the US Naval Academy
  • Served on a Navy ship in the Pacific ocean during WWII
  • After the war, entered flight training, then graduated from the Naval Test Pilot School and the Naval War College
  • In April 1959, Shepard was selected as one of NASA’s first group of seven astronauts
  • On May 5, 1961, Alan Shepard became the first American in space. He flew on a one-person Mercury spacecraft that he named Freedom 7. It launched on a Redstone rocket. On this flight, Shepard did not orbit Earth. He flew 116 miles high and then returned safely. The flight lasted about 15 ½ minutes.
  • After his first flight, Shepard developed a medical problem. An inner ear problem stopped him from flying in space. NASA named Shepard as chief of the Astronaut Office. He helped select new astronauts, plan missions and make sure astronauts were ready to fly. Later, he had surgery to fix the ear problem, and he was able to fly again. Almost 10 years passed between his first and second flights.
  • Shepard's second spaceflight was on the Apollo 14 mission to the moon. He was commander of a crew that included Stuart Roosa and Edgar Mitchell. The Apollo spacecraft was launched on a Saturn V (5) rocket.
  • On Feb. 15, 1971, Shepard and Mitchell landed on the moon. (Roosa stayed in orbit around the moon while the other two landed.) During two moonwalks, Shepard and Mitchell collected more than 100 pounds of moon rocks. They conducted scientific experiments on the lunar surface. Shepard also became the first person to hit a golf ball on the moon, showing how far it would go in the moon's lower gravity.
  • After his second flight, Shepard returned to his job as head of the Astronaut Office. He retired from NASA in 1974. Shepard worked in private business. He also did volunteer work to support education and to help people learn about spaceflight. Shepard died of leukemia in 1998.
