In episode 3, Tom and Paul are joined by Colin Murray (Newcastle University) to discuss Lord Hain’s use of parliamentary privilege to break a so-called “non-disclosure agreement” between a high-profile businessman and a former employee, and the reporting of this incident in the media. They also take a look at the issues in the defamation case of Lachaux v Independent Print, which was heard by the Supreme Court in mid-November.

In episode 2, Tom and Paul debate the “harm” element in English privacy law, have an argument about the case of Cliff Richard v BBC, and review Mark Tushnet’s new book on Freedom of Expression.
