  • Nkosana Makate, Please Call Me inventor

    First Thing is First | In a victory judgment for “Please Call Me” (PCM) inventor Nkosana Makate yesterday, the Gauteng High Court, Pretoria found he was shortchanged by Vodacom and that the cellphone giant must go back to the drawing board to come up with a suitable amount.

    • The court gave Vodacom’s CEO Shameel Joosub one month in which to recalculate what is owed to Makate, using the guidelines issued by the court.
    • Judge Wendy Hughes made it clear that the calculations used by Joosub earlier in offering Makate R47 million, for what the judge called a brilliant invention, was by far too conservative and he is entitled to at least   5% of total voice revenue generated by his invention.
    • The North Gauteng High Court in Pretoria also ordered that Makate is entitled to 27% of the revenue generated by the return of calls sent through the Please Call Me platform
    • The Please Call Me service, which was launched in February 2001, allowed Vodacom subscribers to send a 'Please Call Me' text message free of charge to another user on the same network. Makate had in previous court hearings stated that the Please Call Me system, which he invented while employed by Vodacom, had earned the company about R70 billion in revenue.
    • Makate and Vodacom have been involved in the protracted court battle over payment for the concept since 2008.

    #TheTakeOffInterview | #TeenagePregnacy Pregnancies among adolescent girls remain a global problem. An estimated 21 million girls aged 15–19 years in developing countries become pregnant and about 12 million of them give birth every year.

     

    • Even before the pandemic, in South Africa, 16% of young women aged 15-19 had begun childbearing. The figure ranges between 11% in urban areas and 19% in rural areas.
    • In 2019, nearly 130,000 babies were delivered to girls aged 10 to 19 in public health facilities in South Africa which further increased to an additional 136,386 babies in 2020. The country has recorded an unacceptably high rate of teenage pregnancies in just the first quarter of 2021, with more than 36,000 babies delivered to girls of the same age group (already marking one-third of the annual average – 30.47%).

Is it possible to avoid prosecution if you spend the money knowingly? What would be the valid acceptable reasons for avoiding prosecution ? Walter Sisulu University student Sibongile Mani, who received R14 million into her student account from the National Student Financial Aid Scheme (SFAS), has been found guilty of theft by the East London Regional Court.

    The former accounting student was accused of theft after spending R818,000 of the money.

    • Mani was only entitled to receive R1,400 and had received the money in error.
    • The former student activist spent the money on various items including alcohol, cigarettes, electrical appliances, bedding, toys, and gift cards.
    • The court dismissed Mani's version that she had no intention to deprive NSFAS of its money and that she had no knowledge of the specification of the loan agreement she had with NSFAS.  
    • She was only entitled to a R1 400 food allowance and was accused of failing to report when R14 million was instead credited to her erroneously. She chose to embark on a spending spree. 
    • She is accused of failing to report the error and embarked on a spending spree, blowing more than R800 000 in 73 days.
