Title IX Between The Lines episodes

  • No Contact Orders

When should a college issue a no contact order—and when does a supportive measure become an unreasonable burden?

In Episode 2, Marcus and Mara examine one of the most common tools used by Title IX offices: the no contact order.

Using hypotheticals and the federal court decision in Perlot v. Green, they explore the questions practitioners should be asking before imposing, maintaining, or expanding a contact restriction:

    • Is the institution acting under Title IX or under separate institutional authority?

    • What present problem is the order actually designed to solve?

    • Does a no contact order fit that problem?

    • When is a mutual order truly neutral?

    • When does a communication restriction become a restriction on campus access?

    • How should institutions evaluate claims that an order has become unreasonably burdensome?

    • What happens when there is no formal complaint, no ongoing contact, and no natural end point for the restriction?

    • The episode also examines one-way versus mutual orders, the difference between subjective distress and institutional justification, the importance of scope and duration, and practical ways to document and periodically reassess no contact orders.

The goal is not to argue that no contact orders are good or bad. It is to ask a harder question: What problem is this particular order solving, under what authority, and can the institution solve it without turning a supportive measure into an unearned sanction?

    • Coercion: The Line We Never Drew

What separates persuasion from coercion—and who gets to draw that line? In this episode of Title IX: Between the Lines, we examine one of the most consequential and inconsistently defined concepts in campus sexual misconduct policy. Through real policy language, competing definitions, and difficult hypotheticals, we explore when pressure can invalidate consent, why institutions often disagree about where coercion begins, and what a fairer, more workable standard might look like for students, investigators, and decision-makers.
