How to Prove Service Connection  In this video, I explain how to use lay evidence to service connect your VA disability claim, even if you’ve already filed or been denied.  This information is especially important if your service treatment records lack sufficient medical evidence of any in-service disability or condition.  Side note: This is VERY common veterans!  Why?  Because you often didn’t go to the doctor enough while you served on active duty, and thus, your service treatment records do not contain any evidence of a disability or condition.

I can literally read the VA’s denial letter now: “The veterans active duty service treatment records do not contain any medical evidence or subject complaints of the disability or condition.”  Here’s the deal veterans: You can prove your VA disability claim and overturn previous denials of service connection using something called “lay evidence.”  What is Lay Evidence?  Lay evidence simply means “after the fact evidence” and it must be competent and credible.  “Competent lay evidence” means any evidence not requiring that the proponent have specialized education, training, or experience.  Lay evidence is competent and credible if it is provided by a person who has knowledge of facts or circumstances and conveys matters that can be observed and described by a lay person.

VA Lay Statement Examples  1. A personal statement you write on the VA Form 21-4138 documenting how you think your current non-combat Post Traumatic Stress Disorder is due to an in-service sexual assault and stressor event that occurred 20 years ago IS lay evidence.  2. A Buddy Letter written by someone you served with who can shed some light on how your shoulder separation occurred on active duty IS lay evidence.  3. A spousal letter for sleep apnea, which documents what your spouse has witnessed over the years, and the approximate dates he/she noticed your sleep apnea symptoms began in-service IS lay evidence.  4. A current co-worker’s statement in support of a claim describing the severity of your current PTSD symptoms IS lay evidence.  If you found this video valuable, please give it a like. A buddy letter is simply a credible statement in support of a claim, written by a competent individual 18 years of age or older, who has direct, first-hand knowledge of an event or injury, and offers an account of what they witnessed or are witnessing in support of a veterans VA disability claim. 

These personal statements can be from a fellow service member, spouse, friend, pastor, co-worker, boss, adult child, or any other competent and credible witness. A buddy letter can be the linchpin to winning your VA disability claim.

A VA buddy statement constitutes “lay evidence” under the law, which simply means “after the fact” evidence. The Rating Veteran Service Representative (RVSR) at the VA MUST consider a buddy letter because it’s considered a secondary source of evidence in support of your VA disability claim. 

When writing or obtaining a buddy letter in support of a veterans VA disability claim, you can simply use the VA Form 21-4138, Statement in Support of a Claim.

The VA Form 21-4138, official .pdf form is still the PREFERRED method of any personal statements according to VA Rating Officials. A great VA buddy letter is short and sweet. Think less is more.  

VA Raters are very busy people, so you want to give them the exact information they need, at the moment they need it to help support a Veterans VA disability claim.  

In 3-4 paragraphs, you should explain (1) your name, information, and how you know the veteran. (2) what you witnessed or are witnessing, (3) the veterans’ current symptoms of the disability, and (4) sign and date your name to the best of your knowledge and belief.

🔥 Tip #1: VA C&P Exam for PTSD Overview

After you’ve filed your VA claim for PTSD, you’re likely going to get a C&P exam from a Licensed Psychologist or Psychiatrist at either a VA medical facility by a VA doctor OR by a contracted C&P examiner at a private medical facility.

🔥 Tip #2: VA C&P Exam for PTSD Questions

When you arrive at your c and p exam for PTSD, you’ll likely be handed a 20-question paper exam called the PCL-5. There are a few variations of this self-assessment measure, which may include the PCL-5, PCL-5 with LEC-5, and/or the PCL-5 with Criterion A.

🔥 Tip #3: 8 Things for Your VA C and P Exam for PTSD

1. Know what’s in your medical records! There is no substitute for knowing what’s in your service treatment records, VA medical records, or any private medical records.  2. Review your Disability Benefit Questionnaire (DBQ) for PTSD.  3. Review the eCFR, Title 38, Part 4, Schedule for Rating Disabilities  4. Do NOT have your best day…  5. Be UNFOMFORTABLY VULNERABLE…  6. PTSD claims comes down to your current level of “Occupational and Social Impairment.”  7. Know your true story cold…and potential in-service stressors (or other service-connected disability) that caused or made your PTSD VA worse.  8. You must be prepared to talk about your life in detail. Before joining the military. During the military. And after your active duty service.

🔥 Tip #4: How to Get Your PTSD C&P Exam Results  

If your C&P exam for PTSD was conducted by a VA doctor at a VA facility, your C&P exam results will populate in MyHealtheVet within 24 hours. 

🔥 Tip #5: Questions to Ask Yourself Before Your Compensation and Pension Exam for PTSD 

Do you have a medical diagnosis of PTSD from the military, a VA doctor, or a private doctor? If not, you need to get to the doctor and tell them everything going on with you! ❤️ In this video, Brian Reese the VA Claims Insider explains how to prove your ptsd non combat stressor event.   

This video is specific to veterans who want to learn about ptsd non combat claims, ptsd va rating, non combat ptsd, ptsd rating scale, ptsd disability rating, ptsd dbq, and 70 ptsd rating.   

Recently at VA Claims Insider we’ve seen a string of non-combat PTSD denials because the veteran “failed to corroborate that the veteran was actually present and witnessed the non-combat PTSD event.”  

For example, a Navy veteran had (1) A medical diagnosis of PTSD and was seeking treatment, (2) A personal statement (lay statement) in support of the PTSD claim, (3) A newspaper article about the hurricane event to confirm the stressor event, and (4) A “buddy letter” explaining that the event did in fact occur.  At first glance, it might seem like this should have been a slam dunk case for non-combat PTSD. Not so fast. The veteran didn’t even get a Compensation and Pension (C&P) exam tips and the VA denied the claim. Why? Because the veteran “failed to corroborate that the veteran was actually present or witnessed the non-combat PTSD event.”  

In ALL PTSD non-combat situations you MUST have a buddy letter from a first-hand witness who can corroborate (aka, verify and validate) that YOU were physically present and that you witnessed the stressor event occur.  

It’s NOT enough to simply confirm that the event occurred … you must confirm you were there and witnessed the event, aka, the stressful event happened to you, which in VA speak means “at least as likely as not.”

The first evidence source is something called “Primary Evidence.”  Primary evidence is generally considered the most reliable source for corroborating in-service stressors and should be carefully reviewed when corroboration is required.  

 Primary evidence includes:  Service personnel records and pay records Military occupation evidence  Hazard pay records Military performance reports Verification that the Veteran received Combat/Imminent - -  Danger/Hostile Fire Pay Unit and organizational histories Daily staff journals Operational reports-lessons learned (ORLLs) After action reports (AARs) Radio logs, deck logs, and ship histories Muster rolls Command chronologies and war diaries, and Monthly summaries and morning reports.

The second evidence source is something called “Secondary Evidence.”

The VA may accept a “buddy statement” from a fellow Veteran as corroboration of a claimed in-service stressor if the statement is consistent with the time, place, and circumstances of the service of both the Veteran and the fellow Veteran making the buddy statement.
