A first of its kind capital gains tax in the state has been upheld by the Supreme Court of Washington (SCOW) in a 7-2 ruling that reverses an original Douglas County Superior Court ruling that struck down the income tax on Constitutional grounds. The Washington Constitution prohibits a tax on income, as property, which the seven justices in the majority apparently ignored in crafting their legal opinion released this morning (March 24, 2023).
