Today we are going to tell you about,

When an accused is arrested under what I.P.C. Section he is arrested is

important. As each section is either Bailable or non-bailable, when the

crime is bailable then the accused can get bail even in the Police station

itself on paying the bail amount or personal bail bond. When the crime

wherein the punishment given is 3 years more than 3 years then it becomes

non-bailable.

When the crime is Bailable the accused gets Judicial custody and after

paying the Bail amount or giving a surety of like the amount he is released on

bail.

When an accused is arrested under the non-bailable section if the police do

not file a charge sheet or prolong the same then the accused can apply for

bail. For getting this type of bail he can site section 437 of Criminal

Procedure Code 1973.
