FMCSA floated the idea in a Sept. 23 Federal Register advance notice of proposed rulemaking, saying truck unique electronic identifier technology capable of wirelessly communicating when queried by federal or state motor carrier safety enforcement personnel had the potential to improve efficiency and safety on the roadways, enabling enforcement agencies to focus their efforts on high-risk carriers and drivers.

The ANPRM was posted in response to petition requests by the Commercial Vehicle Safety Alliance, first in 2010 and again in 2015.

Those supporting the potential of the idea, but withholding full support due to various uncertainties, included American Trucking Associations, the Truckload Carriers Association and the National Association of Chemical Distributors.

A sample of hundreds of owner-operators and small truckers, as well as the Owner-Operator Independent Drivers Association, were strongly opposed. Comments by the PrePass Safety Alliance and Drivewyze Inc. also were critical.

Outwest Express, a full truckload carrier, and American One, a professional services provider, agreed to the settlement to voluntarily resolve a sex discrimination and retaliation charge filed with the EEOC. Both companies are based in El Paso, Texas.

“We are glad to resolve this matter through voluntary compliance, which benefits the recruiter, the companies and the public interest,” David Davis, acting director of the EEOC’s St. Louis District, said in a news release. “Outwest Express and American One Source have agreed to provide appropriate relief and improve their workplace policies and procedures to prevent future harassment and retaliation.”

In addition to providing monetary relief for the recruiter, Outwest Express and American One Source will train their supervisors and employees and report to the EEOC for three years.

Outwest Express, founded in 2004, operates 487 trucks and employs 491 drivers, according to the Federal Motor Carrier Safety Administration.

The agreement resolves a sex discrimination and retaliation charge recently filed with the EEOC from a female recruiter who said he was fired immediately after complaining that her boss frequently “cursed” and “ridiculed her,” the EEOC said.

The recruiter, who wasn’t named, was hired by American One Source and worked at Outwest Express’ terminal in Kansas City, Missouri. Her job was to recruit and train new truck drivers.

“The woman alleged to the EEOC that during her three months of employment, her boss repeatedly cursed at and ridiculed her but that he did not treat male employees in a similarly demeaning manner,” according to the agency. “She also alleged that when she complained to human resources about the treat­ment, she was fired the next morning.”

The EEOC investigated and determined the companies’ alleged conduct violated Title VII of the Civil Rights Act of 1964, which prohibits discrimination based on sex and retaliation for complaining about discrimination. Outwest Express and American One Source deny the recruiter’s allegations.

It’s an incentive that has driven better safety for its fleet.

Netradyne’s scoring system is based on “science of change,” and one of the its principles is positive reinforcement. A study at a New York State hospital where the goal was to increase the frequency at which medical staff washed their hands before entering patient rooms found that staff knowing they were being recorded by cameras was not enough to change behavior. With the addition of an electronic board in the hallway of the unit that gave employees a positive message and displayed the shift’s current hand hygiene score, compliance rates reached 90% within four weeks.

Austin Schmidt, director of performance marketing at Netradyne, said that’s operant conditioning where people are wired to adjust their behavior, often even subconsciously, to obtain the outcomes we want.

That’s one key factor in transforming safety from a cost center to a cost saver, Schmidt said during a recent Truckload Carriers Association webinar.

“I really love this quote from Charlie Munger, a Warren Buffett business partner, that explains operant conditioning: ‘Show me the incentives, and I'll show you the outcome,’” Schmidt said. “Cameras or most other technologies on their own will not automatically reduce your operational costs. But the good news is that leveraging two key principles of the science of change within your organization will.”

The other principle is instant feedback. A study called Timing Matters: The Impact of Immediate and Delayed Feedback on Artificial Language Learning assessed the impact of immediate versus delayed feedback on learning a second language and found that even a two- to three-second delay reduced a student's ability to learn from their mistakes by 21%.

Those studies illustrate that simply adding a driver-facing camera won’t change behavior; drivers need to be incentivized. They also show the importance of instant feedback because delaying feedback by waiting until a monthly or quarterly safety meeting reduces a driver’s ability to correct their mistakes.

But there are cost-saving opportunities and solutions, Schmidt said, which are becoming increasingly important with the rise of operational costs and the fall of freight rates, creating an unsustainable economic environment for fleets.

“If your expectations are that, considering all the inflation and economic concerns, we are going to achieve retail sales at the levels that we saw last year — yes, this year is going to be successful,” Foreman said in the interview.

He’s expecting “small increases in sales on dollars, but on volume — the number of units, the number of physical orders — it’s going to be the same as last year,’’ he said.

Compared with pre-pandemic volumes, “we’re way up,” by perhaps 15%-20%, he added. This year’s slight increase in spending will be partly due to inflation, and the unleashing of some delayed purchases.

‘Moving Forward’

“People have waited to spend — we saw suppressed spending in the summer waiting for these discounts to come on these higher-end items, whether it be a high-end pair of shoes or whatever that might be,” Foreman said. “Now they’ve got the discounts and they’re moving forward with the spending.”

Foreman’s views jibe with those of the US’s National Retail Federation, which said Tuesday that a record 196.7 million American consumers flocked to stores and e-commerce websites over the Thanksgiving holiday weekend in search of deals. (Read more of that story here.)

Retailers’ price reductions through the holidays should help them work through bloated inventories, and Foreman sees 2023 as the year of transition for supply chains to return close to normal.

“When you think of a global supply chain, it is a rhythm, it is something where every step needs to happen in order to create balance and equilibrium,” he said. “The pandemic hit and we cut parts of those chains off and had to bring them back together again, and it created this pendulum of surges where we had these big hills and valleys.”

Next year, it’s going to be all about “creating that rhythm back into supply chains, back into infrastructure, back into some economic stability and I really think as we come out of 2023, were going to have a larger sense of normalcy.”

Experts are mixed: While some believe that just-in-time has no place in the supply chains of the future, others say a modified version of the strategy will still be necessary to maintain resilience while keeping costs down.

Supply Chain Dive reached out to three experts in supply chain management to ask: Did the pandemic kill just-in-time? Here are their responses, which may be edited for length and clarity.

Just-in-time is not dead; however, the days of taking the concept literally and ordering inventory to arrive ‘just in time’ is dead. The just-in-time concept has always accounted for common sense decisions. For example, if ordering strategic inventory from China, you should account for likely demand and supply volatility and stockpile inventory appropriately. With that said, most businesses were completely focused on efficiencies prior to the pandemic and took just-in-time literally, assuming the supply chain would continue to support their needs. They went through the motions of assessing risk, but did not adjust their inventory profiles and were left empty handed during the pandemic.

Executives have realized that the supply chain is a system of systems, and no one can control the end-to-end supply chain, let alone their link in the supply chain. Instead of living on hope, they are assessing supply chain risk, reevaluating their supply chain footprint, dual sourcing key products or materials and determining where to locate strategic capacity and inventory to support changing demand patterns. As a pending recession is looming, smart executives are tightening their control over inventory while still accounting for their risk, footprint and customer conditions. As companies reshore, nearshore, expand capacities and rollout advanced technologies, supply chains will reshape for the future.

If companies are following the literal just-in-time methodology, they will wind down during this reshaping process. It will not be for the faint of heart as it will require taking on risk, reconfiguring and expanding where it makes sense, and investing in inventory to support customer success. On the other hand, for those following the just-in-time concept, they will incorporate the these changing conditions and right-size their inventory to support profitable growth.
