Montenegro falls again in political chaos. The Parliament of Podgorica approved on 1 November a new law on the powers of the President of the Republic, which in fact goes against the provisions of the current constitutional text. This immediately triggered the criticisms via social media and protests through the streets of the capital, supported by the parties in the opposition. All this led to an aggravation of the already confused situation around the formation of the new government. The outgoing executive in fact, led by Dritan Abazović, had been disheartened on August 19th. Since then the country has been in a situation of political crisis without a solution on the horizon.

The unconstitutional law

The law on the powers of the President of the Republic is only the tip of the iceberg. Approved by a restricted majority, 41 parliamentarians on 81 seats in Parliament, the new law provides that the president is obliged to propose a designated prime minister, if the latter has the favorable opinion of at least 41 parliamentarians. If this majority is not reached, the president is called to organize a second tour of consultations with political parties and propose another candidate. The new law therefore allows the majority of parliamentarians to sign a petition and support a candidate to play the role of premier, in the event that the president refused to propose it. What is contained in the new legislative text, however, must be against the constitutional provisions. The Montenegrin Constitution in fact states that the president must, within 30 days, start the tour of consultations with the parties and propose a designated prime minister, who has the support signed by at least 41 parliamentarians. The accusation to this law therefore, moved by various NGOs, is to undermine the constitutional powers of the president and to put the party interests before the Constitution, and consequently to the popular will.

The conflict on the law reflects the growing tension between the outgoing premier Abazović and the President of the Republic Milo Djukanović, leader of the Democratic Party of the Socialists (DPS), now in the opposition. The outgoing premier publicly accused the president of being responsible for having thrown the country towards political destabilization, abusing his constitutional powers and blocking political dialogue.

The Montenegrin Finance Ministry announced on Thursday that the country will repay $4 million to Libya, its part of Yugoslavia’s debt to the African state for oil imports.

“During meetings with Libyan officials on October 12, a final agreement was reached,” the ministry said.

It added that the debt will be settled “in the shortest possible time”.

In August 1975, the National Bank of Yugoslavia issued guarantees for a loan of $70 million, which was used to build a Yugoslav oil pipeline.

In July 1981, Yugoslavia took another loan in the amount of $150 million, which Libya granted for the import of its oil.

The loan agreement was concluded between the Central Bank of Libya and the National Bank of Yugoslavia, guaranteed by the Yugoslav government.

The Montenegrin government said it must repay the Yugoslav according to an agreement signed in June 2006 between Serbia and Montenegro when their unitary state ended.

According to the agreement, Yugoslav financial rights and obligations are split between Serbia and Montenegro, with 94.12 per cent going to Serbia and 5.88 per cent to much smaller Montenegro.

After the collapse of Yugoslavia, Serbia and Montenegro in April 1992 established the Federal Republic of Yugoslavia, declaring the newly formed federation to be Yugoslavia’s successor.

In June 2006, Montenegro formally declared independence after parliament by a majority vote accepted the results of a referendum held in May, in which voters backed splitting from Serbia.

According to the latest government data from 2019, Montenegro has to repay a $850 million debt from the Yugoslav era.

Under Josip Broz Tito’s Yugoslav socialist federation, its six republics were allowed to take on loans independently for infrastructure projects, agriculture, electricity, water management, forestry and transport.

Croatia and Slovenia – the only former republics which have so far joined the European Union – have paid off their debts.
