On August 17, 2024, at approximately 4:19 AM, a Rockledge Police Department officer responded to a vehicle that had lost control and was parked positioned between two concrete curbs on North Barnes Boulevard in Rockledge, Florida. Upon arrival, the officer found a driver slumped back in the seat and unresponsive in a 2009 silver Toyota sedan.
An officer made entry through the window to check on the driver. While speaking to the individual, the officer noted slurred speech and struggling with walking. The individual consented to and performed field sobriety exercises. The officer observed several signs of impairment during the exercises, including lack of smooth pursuit and nystagmus during the Horizontal Gaze Nystagmus test, inability to keep balance, stopping to steady, and incorrect turns and steps during the Walk and Turn test, and swaying and incorrect counting during the One-Leg Stand test.
The individual was placed under arrest for driving under the influence of drugs. The individual agreed to a breath sample, which resulted in 0.00 for all samples, but declined a urine sample. During a vehicle search prior to impound, officers found a pill bottle with another person's name on it containing multiple pills. They also found a clear cylindrical tube with a white powdery substance that tested positive for opioids (yellow oxycodone).
