A Minnesota federal judge issued a fiery warning against ICE, accusing the agency of violating nearly 100 court orders—forcing immigrants held without legal status to remain detained despite rulings. Judge Schiltz, appointed by George W. Bush, stressed that no agency is above the law, calling the rule of law “oxygen for democracy.” He blamed both staffing shortages and Justice Department oversight for the chaos, noting his court’s staff worked grueling hours without pay to keep up with a flood of habeas petitions. Though DHS insists its actions are constitutional, the judge’s rare public rebuke underscores a nationwide crisis as courts struggle to enforce legal orders amid heightened immigration enforcement. The surge eventually ended in February, but Schiltz hopes his case reveals how vital the rule of law remains—even under pressure.
