In this episode, we hear from Professor Benjamin Barton, Helen, and Charles Lockett Distinguished Professor of Law at the University of Tennessee College of Law, and a research fellow for the Center for the Study of Social Justice. 

He is a prior director of clinical programs at the College of Law.  Professor Barton is the author of several books, including Fixing Law Schools; Rebooting Justice; Glass Half Full: The Decline and Rebirth of the Legal Profession; and the Lawyer-Judge Bias in the American Courts. During the podcast, he discusses the challenges in legal education and the reforms required in areas such as bar passage and debt load to "fix law schools," as well as the necessity of increasing access to justice for those traditionally deprived of that access. Professor Barton explains the premise of his next book, The Credentialed Court: Inside the Cloistered, Elite World of American Justice, which will be published in 2022, and the results of his research into the topic. Professor Barton also shares the successes he and his students are achieving utilizing A2J author software and basic coding to create tools and increase accessibility to legal solutions for the public.

The program is cross-disciplinary and is helping meet the needs of NASA and the public and private space initiatives that are in need of those trained in these evolving areas of law. Mississippi College of Law also explores Drone Law & Policy in its newly created law journal. Dean Duncan shares her path to the deanship and her predictions regarding the evolution of legal education.

Professor Tenninbaum discusses his work in Productizing Legal Work and the new textbook with that focus in support of law students and legal professionals. He discusses Spaced Repetition, his new book, and the novel approach that Suffolk has in weaving legal tech into its curriculum. Professor Tenninbaum mentions his Lawtomatic Newsletter that he shares weekly, and provides his opinions regarding the future of legal education and the evolution likely to happen in the practice of law.

Burke, Dean, and Dave Frohnmayer Chair in Leadership and Law at the University of Oregon School of Law, a position she has held since 2017.

Dean Burke is a graduate of Yale Law School, where she served as editor of both the Yale Journal of Law and Feminism and the Yale Journal of International Law. Following a clerkship with the Honorable Raymond A. Jackson, E.D.V.A., she practiced at Cleary, Gottlieb, Steen & Hamilton, focusing on environmental law, antitrust, and civil and criminal litigation. Her experience in environmental law and natural resources led to positions in the U.S. Department of the Interior's Bureau of Land Management, including Deputy Director for Programs and Policy, and Acting Assistant Secretary for the U.S. Department of the Interior. Dean Burke taught as a visitor at Rutgers School of Law and as Associate Dean and Associate Professor of Law at the University of Houston Law Center, a journey ultimately leading her to the Oregon Law deanship and her green and yellow attire every day!

According to U.S. News & World Report, Oregon Law includes 3 top-ranked programs: Legal Writing, Environmental Law, and Dispute Resolution. Under Dean Burke's leadership, Oregon Law is focusing on four areas of strategic emphasis. In this episode, we hear from Dr. Chad Christensen, Project Manager for the Law School Survey of Student Engagement (LSSSE) at Indiana University Bloomington, who develops and implements strategic initiatives to expand LSSSE's impact at law schools and on legal education. 

Dr. Christensen shares the longitudinal data from the approximately 186 different law schools and more than 400,000 law students since LSSSE's inception in 2004, and describes the usefulness to law schools that choose to participate in the annual survey process. In addition to publicly releasing aggregate results on an annual basis, Dr. Christensen and his LSSSE colleagues collaborate with law schools seeking to interpret and analyze their own survey results and provide consulting services to schools seeking to maximize the law student experience.  This podcast is particularly timely as the recent results of LSSSE explore the impact of the COVID crisis on legal education, providing deeply disturbing findings from the 13,000 responding law students at more than 60 law schools. Responding students reported concerns about meeting basic needs like adequate food and paying their bills, as well as increased depression, anxiety, and mental and physical exhaustion, with significant disparities among different races and gender. Dr. Christensen digs into these heartbreaking results but also notes that students reported positive interactions with classmates and professors, despite the alternative delivery models for legal education required by the pandemic. Dr. Christensen shares how future iterations for LSSSE can further influence the evolution of legal education and provide increased insight into the law student experience.

Professor McMurtry-Chubb previously taught at a number of institutions, including the University of Iowa, Loyola Law School in Los Angeles, California State Polytechnic, Drake University School of Law, and Fairhaven College, where she was the co-founder and first director of Fairhaven's Center for Law, Diversity, and Justice, the first interdisciplinary full-time residential pipeline program in the country. Dean McMurtry-Chubb is a prominent critical-race-and-gender scholar who is the architect of UIC Law's 1L Antiracism Curriculum Project, and now directs the Law Schools' new, first of its kind,  JD Concentration in Critical Race & Gender Studies, programs she discusses at length in this podcast episode. Dean McMurtry-Chubb shares the impetus for, and the resultant work, in creating a comprehensive guide for integrating DEI into the core law curriculum. Her new book, Strategies & Techniques for Integrating DEI into the Core Law Curriculum: A Comprehensive Guide to DEI Pedagogy, Court Planning, and Classroom Practice, is available for free from Wolters Kluwer Legal Education. Dean McMurtry-Chubb explains why law schools need to think broadly when integrating DEI, challenging systemic barriers and traditional pedagogy in an effort to avoid complicity in inequity in legal education.
