This week we follow on from last week’s episode, where an employee was dismissed for verbally abusing his colleague – then took his case to an Employment Tribunal. The Tribunal agreed the employee was unfairly dismissed and also noted that the choice of dismissal was too harsh a sanction to apply to the employee’s case. In this episode, we also look at the legal test the Tribunal used to come to it’s decision and we provide pointers for what you should look for, from your employer’s conduct of your disciplinary - should you find yourself facing a dismissal for misconduct at work.
