This week we look at a couple of issues that have arisen with your employer's interpretation of 'furloughed status'; we look at what's happening with holidays and leave entitlement impacted by the lockdown; we look at redundancy; we also look at what is happening to workers caught inbetween jobs at 01/03/2020; and finally we take a brief look at your rights when working from home. 

Our podcasts have changed for the forseeable future, and we will continue to use this space to update you about changes to your job and your employment rights - for as long as there is still impact on jobs and rights due to the corona virus.

I hope we’re all managing to stay safe in these testing times.

Since we were here last week, things have certainly ramped up again.

By now, as many as a fifth of the UK workforce will be working from home because of the corona virus.  That’s as many as 6million workers.  And as a result of this there are questions workers are raising about their employment rights, which need to be clarified, particularly after the prime minister and chancellor’s statements about payments to workers.

So, this week’s episode is all about updating you and answering questions on employment matters linked to the corona virus or covid19 as it’s also commonly called.

Lots of people have been contacting me, asking about their employment rights during this corona virus outbreak that we’re dealing with.  It’s clear from the questions I’ve been receiving, that people are worried and frightened about what might happen if they are told to stay home from work for a period of time.

Thanks for tuning into this week’s podcast.

This week, I’m looking at the thorny subject of your employment status and IR35.

Things used to be so simple before 6th April 2017.  But since that date, private contractors and freelancers, who contract services through private companies, to public sector bodies, have been treated as workers for the purposes of collecting tax and national insurance at standard employee and worker rates.

In this edition of the podcast, I explore all things IR35 and what this HMRC regulation means for your employment status.

I’ve included a summary of three cases that HMRC have lost at employment tribunals, against people who have challenged HMRC’s assessment of their status as IR35 workers. You can read the summary  here or by clicking the link at the bottom of the show notes.

Welcome to this week's edition of the podcast.

This week we’re looking at the six steps you need to take to make a complaint about discriminatory treatment at work.  To help you I’ve created two templates you can download and use straight away.  You can get the downloads here

So in last week’s podcast, we took a brief look at the employment rights you have before you start working for a prospective employer.     We looked at this based on the assumption that you are an external person outside the company, applying for a job with a new employer.  Simultaneously to this, we also looked at your protection under the Equality Act 2010, because you belong to one of the 9 Protected Characteristic groups.

In this week’s episode we stick with the same subject, but this time we look at your employment rights as a member of a Protected Characteristic Group, when you believe your employer has discriminated against you during the recruitment and selection process, after you applied for a job within the company.

We look at the grievance and appeal steps you can take and we also take a brief look at the Employment Tribunal steps you can take to make a complaint about.

So, why employment rights you might ask? Well, we have never had so much uncertainty about employment status and the question being asked, is whether ever worker is the same. Workers are wondering whether their gigger status, or IR35 status, or zero hours contact status, or permanent contact or term time working, are all the same and whether everyone working on these types of contacts, are entitled to the same employment rights. The answer to this is 'NO', but the uncertainty about where to get the information about contacts and rights can be difficult to pin down - and that's why we're here!
