  • All You Need To Know About Medical Malpractice In Santa Ana - Entrepreneur Podcast Network – EPN
Medical malpractice is a type of personal injury suit that involves a doctor or medical professional who negligently does something to cause an injury to their patient. It can happen frequently, and is a result of someone deviating from the standard care of treatment is; that deviation ends in the patient either being hurt – or in some instances, killed. A physician can be negligent by either doing something that causes harm to someone, or failing to do something that directly ends with someone being harmed.
When you are the victim of medical malpractice in Santa Ana, it is imperative that you hire an attorney who specializes in the complexity of proving your medical malpractice claim. There are things that will help to win or to lose your case, and only an experienced professional will know the difference and how to guide you to get the compensation you deserve.
    Statute of limitations
In the state of California, there are time limits that you have to file for medical malpractice. If you don’t file within that timeframe, you might not have a case at all. The law stipulates that you have up to one year to file a malpractice suit. If there is a reason why you could not have known about your injuries – in other words, if there was a delayed discovery – then you might have up to three years from the date of the injury. But if you are a victim, it is important to file suit as soon as possible to ensure that you don’t miss the time limit you have.
Are there medical malpractice caps in California?
California does have a cap on how much someone is entitled to collect in a medical malpractice suit. The patient is allowed to sue for both economic and noneconomic damages related to the claim, but the total amount they can recover for noneconomic damages is capped at $250,000. Economic damages for malpractice are things like medical bills and lost wages, while noneconomic damages include factors like loss of consortium, pain and suffering, and emotional distress.
For some, the hardships and harm of medical malpractice can far exceed the medical malpractice cap, which for some plaintiffs feels completely unfair. The cap was put into action due to the high jury amounts awarded in malpractice cases and how they were affecting the healthcare system and economy as a whole.
As the figures of awards continued to climb, so did the rates of malpractice insurance – and the amount that patients were paying for their medical insurance premiums. Although it seems unfair, the cap was put into place so that there wasn’t a crash of the medical system, where no one could afford to gain access or to administer healthcare.
What do you need to prove a medical malpractice suit?
If you want to prove your medical malpractice case in Santa Ana, you have to prove four components:
    Duty of care
    Breach of duty
    Proximate cause
    Damages
First, you must prove that the physician had a relationship with you where they had an obligation of duty. If a relationship can be established, then you have to prove that the duty of care was breached. Breaching the standard of care can mean that the doctor either did something to cause your injury, or that their failure to administer care caused you to be injured.
If you can prove that the doctor did something wrong or didn’t take action when they should have, then you can prove breach of duty.
The third thing you must prove is that the breach of duty is directly related to you being injured. And finally, you must prove that the damages were realized and real.
If you are injured by a physician in the Santa Ana area, it is important that you file a claim immediately. The first step you should take is to hire a Santa Ana medical malpractice specialist who understands the specifics of a malpractice lawsuit. Since you have to know about …

  • Ladder to Leach Pad: 5 Important Facts About On-the-Job Injuries - Entrepreneur Podcast Network – EPN
Every job has its risks. A fall from a short or tall ladder can leave you disabled. A fault in a leach pad can leave you dead. Every worker has rights when injured on the job, and every employer owes some accountability. But, frequently, it takes a construction injury lawyer to stand with you.
Here are 5 important facts about on-the-jobs injuries:
Report injury ASAP: Workplace injuries are not limited to crushing traumatic injuries. Business Insider summarized The Bureau of Labor Statistics report, “the most common injuries requiring days off were sprains, strains, and tears (accounting for 38 percent), the most common source of those was ‘overexertion in lifting or lowering’ and by far the most common thing injured was the back.”
There are slip and falls, cumulative stress injuries, and short- and long-term diseases. There are irritations of the eyes, ears, and skin, and there are many more work-related conditions. But, you have an obligation to yourself and the employer to report the injury as soon as possible.
Get a report: The Supervisor must prepare an accident report. Complying quickly is important to the employer, required by OSHA, and valuable to you. Accident reports are standard, usually provided by the Workers’ Compensation insurance company, and readily available to the Supervisor, in the Human Resources office, or online at some businesses.
Your report doesn’t have to be on the company form. You can write a letter reporting details of the accident and injury. Sign and date the letter, and keep a copy for your records. It holds up better if you can get the Supervisor to sign that it has been received.
See the doctor: It’s your decision to seek treatment. Employees pay nothing for Workers’ Compensation insurance, so the company may try to resist frivolous claims. But, the doctor is obliged to treat you in the context of the existing insurance program.
In most cases, employees benefit from the doctor’s diagnosis and prognosis. You should comply with the doctor’s directions. If you do not, the employer may claim that you have not cooperated in your own care. If you do and the doctor restricts your work, you and the company must comply with those restrictions. You have the right to return to your work, and the employer is obliged to accommodate your needs where possible and reasonable.
Alternative care: If the doctor’s treatment isn’t working for you, you have the right to petition for care by another practitioner. (Some jurisdictions permit this option from the start.)
That means you can also seek effective treatment from physical therapists, psychological counseling, or massage, acupuncture, and chiropractic practitioners.
Right to Compensation: After a defined waiting period (e.g., 3-days), your pay must resume despite lost time. If the company fails to comply or fails to honor your claim, you have the right to pursue your own interest in state industrial court. And, you may appeal that court’s decision if not satisfied.
And, you are assured the right to representation by a qualified lawyer at all steps in the process to make your loss whole.
    Ladder to Leach Pad
The Industrial Safety & Hygiene News gathered some statistics on construction industry injuries.
One in ten construction workers are injured every year.
Falls are the greatest cause of fatal construction injuries.
The job with the highest injury rates in the construction industry is ironwork.
Construction workers account for y% of reported lead poisoning in the United States.
In doing so, they clarify why it is your employee right and necessity to seek representation by a qualified construction injury lawyer.

  • What Are The Six Types Of Protections You Can Seek In Seattle? - Entrepreneur Podcast Network – EPN
In the state of Washington, a person can file for an order of protection against someone who is threatening them or behaving in an abusive manner. The main objective of the order of protection is to stop one party (the “respondent”) from contacting the other (the “petitioner”). There are varying degrees of the types of orders of protection that a person can seek according to how dangerous their situation is. An “extreme risk” protection order is intended not to cut off communication, but rather to force a “respondent” to surrender any weapons that they might be in possession of.
The type of order that someone seeks depends on the situation they are facing. There are six different protection orders that a petitioner can request from the court. There are specifics related to who can seek a protection order, what they can try to protect themselves from, and the protection that will be offered to the petitioner.
    Anti-harassment Protection Order
An anti-harassment protection order is used when the petitioner is the victim of harassment by another person. An anti-harassment order might be filed by either an adult who is being victimized by harassment, or the parents of a child under the age of 18 who they believe is being harassed. A parent has the right to file a petition against any adult whose behavior has a negative effect on their child, any minor child who has a history of harassing their child, or anyone who is being investigated for doing so.
    Domestic Violence Protection Order
If you are the victim of domestic violence, then you can request a domestic violence protection order, which is initiated to protect you from violence. Those who can petition for a domestic violence protection order include anyone who is married, has a domestic partner, a person who has a child with someone else, people who live together, anyone who is 16 or older and in a dating relationship, anyone who is related through marriage or blood, and anyone who is in a parent-child relationship, which includes step-parents and grandparents.
Domestic violence is defined as sexual assault, stalking, fear or intimidation, bodily harm, or assault.
    An Extreme Risk Protection Order
Someone would request an extreme risk protection order so that law enforcement has the right to stop the respondent from either having control or custody of a firearm, or purchasing or possessing one. To have an extreme risk protection order approved, you must prove that the respondent poses a danger of injury, either to themselves or to someone else.
    Sexual Assault Protection Order
Anyone over the age of 16 can file a sexual assault protection order if they have been a victim of sexual assault, unless they qualify instead for a domestic violence protection order. Someone other than the victim can file on the victim’s behalf if the victim is not of age, is vulnerable or impaired, they have a disability, or they have no access to healthcare.
    Stalking Protection Order
A stalking protection order is a petition that someone can file if they don’t qualify for a domestic violence protection order. A stalking protection order can be filed by the victim of a stalker, or by someone other than that person (in the case of minor children), someone who is vulnerable or impaired, or someone who is concerned for the victim.
Stalking is defined as being harassed repeatedly. It also includes any behavior that intimidates, frightens, or harasses someone that the respondent either knows or even doesn’t know. It can also include electronic communication.
    Vulnerable Adult Protection Order
To file a petition for a vulnerable adult production order, the victim must be abandoned, abused, financially exploited, neglected or had the threat of any of those circumstances. The order is filed on behalf of the vulnera…

  • Texts Being Ignored? 5 Major SMS Marketing Mistakes - Entrepreneur Podcast Network – EPN
With mobile technology on the rise, marketing techniques have started taking a new turn. There is a great opportunity to catch people while they’re on the go through SMS marketing, which sends text messages to interested parties and potential customers.
But among all of the opportunities for success, there are also a lot of avenues for failure through the SMS marketing method. It’s essential to be aware of the pitfalls of SMS marketing if you are looking to make this an effective marketing technique.
Here are the top 5 major SMS marketing mistakes to avoid during your campaign.
    1. Sending Too Many Messages
One of the biggest mistakes that entrepreneurs make when exploring the SMS marketing avenue for the first time is the fault of sending too many messages at once. Customers will get easily irritated if they receive too many messages from you. While you may think that it’s a great tactic to send a text a day, this will prove to be far too much for the average consumer to handle. Nobody wants to be spammed with a lot of messages in their inbox. If you’re just starting out, try to send just one text a week. This is the best way to prevent customers from blocking you or unsubscribing from your mailing list.
    2. Having a Small Contacts List
If you don’t have many contacts to send messages to, then you might just be wasting your time with the SMS marketing method. Without enough contacts and phone numbers, you are spending too much time and money with very little results. In order to solve this issue and expand your contacts list, you need a bigger reach. You can use marketing software platforms like UltraSMSScript to help post your SMS information through your social media profiles, online forums, and more.
    3. Forgetting a Call to Action
A Call to Action, also known as a CTA, is one of the most powerful and vital marketing tools in any campaign. This is the short phrase that asks the customer to take action in order to do business with them. For example, a great Call to Action would be, “Get a free quote!”, or “Contact us today!” A weak or nonexistent Call to Action results in a lack of caring by the customer. You must compel them to do something in order to engage them in business.
    4. Being Too Generic
While there are some great SMS campaign templates available get you started, having a generic SMS campaign can often run you into the ground. If your messages don’t stand out to your clients, they aren’t going to pay attention to you. Instead, you should make personalized offers and include information that is relevant to your company. Think about your target audience. What is the general age, interests, or social groups of your audience? Write a campaign that appeals to them the most.
    5. Sending Messages in the Middle of the Night
Another common mistake that SMS campaigns make is that the text messages are sent at the wrong time. You have to carefully plan when you send them, since most texts are read within 5 minutes of receiving them. The best time to catch clients and get their full attention is in the evening, right when most people get off work. Between 5pm and 7pm is a peak time to catch clients’ attention. If your business is food-based, try to catch them in the early afternoon with special offers and discounts.
Avoid These Mistakes to Make an Effective Campaign!
You don’t have to worry about failing right from the start, but as you can see, there are a few beginner’s mistakes to be aware of. As long as you understand how to run an effective SMS marketing campaign, and you can tailor to your audience without sounding too generic, then you are on your way to success.

  • What Happens If You Refuse To Take A Breathalyzer Test? - Entrepreneur Podcast Network – EPN
Drunk driving is a serious problem across the United States. According to the Centers for Disease Control, in 2015 alone, 10,265 motorists died due to alcohol-related accidents. If you are found guilty of driving while intoxicated, it can come with some hefty consequences – not just in fines, but you may also face prison time, depending on the state where you live.
A breathalyzer test is the first line of defense that law enforcement uses prove that you are driving under the influence. It’s a machine that you blow into that evaluates your blood alcohol concentration. Based on what your BAC is, you can be charged with driving while intoxicated. If you are suspected of drinking and driving the officer will ask you to take a breathalyzer test; although it is your right not to take it, if you refuse you could risk having your license taken, or even going to prison, whether you are legally intoxicated or not.
Although you might not be arrested if you refuse to take the test, there are other things that an officer can use to test your sobriety and to try to prove that you are intoxicated. Things like a field sobriety test, witness testimony, or even taping you might be used against you to charge you with driving while impaired.
In some jurisdictions, if you refuse to take a breathalyzer test then that refusal might be used against you if your case goes to trial. Some state laws make it a penalty to refuse a mobile breathalyzer test and make that a different penalty than refusing to take an after-arrest blood urine test or a breath test that is administered either at the hospital or after you are taken to the police station.
    What are implied consent laws?
Driving is considered a privilege, not a right. This means that if you refuse to take a breathalyzer test when asked, the officer may take your license, levy hefty fines against you, or even remand you to prison just for failing to take the test, even if you are not legally drunk. “Implied consent laws” mean that you consent to being tested by a breathalyzer simply because you agreed to the rules of the road when you were given the privilege of driving. Therefore, if you do not take the test, then you might face an automatic suspension of your driver’s license.
States often penalize those who refuse to take a test by immediately suspending their driver’s license for up to 12 months, but that is decided at the state level. Those who have previous DUI convictions might face suspension or prison time, which can be even longer if they refuse the breathalyzer. There are some drivers who would rather face the consequences of failing to take the test than risk being charged with wanton or reckless driving, which can carry heavier sentencing times. For those with multiple DUI convictions, whether they take the test or not, the penalties will be severe.
According to the National Highway Traffic Safety Administration, up to 20% of those who are suspected of drinking while driving refuse to take the breathalyzer test.
    “No-Refusal” Enforcement
“No-Refusal” enforcement was a response by some states for those drivers who refuse the breathalyzer test. No-refusal laws allow a suspect to be forced to take the test under the authority of a warrant. In those states, police officers may obtain electronic warrants that are streamed to their mobile devices that make suspects take the breathalyzer test without the right to refuse.
If you are pulled over for the suspicion of driving while under the influence, in most cases it is better to take the breathalyzer test than to not take it. Unless you are facing multiple DUI charges, the penalties for not taking it are usually only combined with a guilty charge in court. If you don’t take the breathalyzer test, it is almost like an admission of guilt. If you have…
