Nevada ACLU is appealing a Las Vegas judge's ruling that the state Education Savings Accounts are constitutional. Amy Rose the ACLU Legal Director says District Court Judge Eric Johnson made the wrong decision and evaluated the case improperly. In May, Johnson dismissed the ACLU’s lawsuit against program called it “neutral with respect to religion” because parents- not the state- decide whether they will use the program to pay for tuition at private and religiously affiliated schools. Johnson also ruled a provision in the Nevada Constitution that says state lawmakers should encourage education “by all suitable means,” permits the ESA's. The ACLU says it violates a clause in the state constitution that bars the state from funding religious entities. The ESA's offers parents about $5,100 in per-pupil state funds to spend on private school tuition, home-school expenses and other educational services if they pull their children out of a public school.
