New CDL drug testing requirements

As of my last knowledge update in September 2021, the drug testing requirements for commercial driver's license (CDL) holders in the United States were governed by the Federal Motor Carrier Safety Administration (FMCSA) regulations. Please note that regulations and requirements can change, so it's important to verify the most up-to-date information from the FMCSA or relevant state authorities. Here are some key points regarding CDL drug testing requirements:

  1. Pre-Employment Testing: Before a CDL holder is hired by a new employer, they are typically required to undergo a pre-employment drug test. This test checks for the presence of controlled substances, including marijuana, cocaine, amphetamines, opioids, and PCP.
  2. Random Testing: CDL holders are subject to random drug testing throughout their employment. Employers are required to use a scientifically valid method to select drivers for testing. The percentage of drivers selected for random testing can vary each year based on the FMCSA's guidelines.
  3. Reasonable Suspicion Testing: If a supervisor or employer has reasonable suspicion that a CDL holder is using drugs, they can request a drug test. This suspicion must be based on specific observations or behavior that suggests impairment.
  4. Post-Accident Testing: After certain types of accidents, such as those involving a fatality or serious injury, the involved CDL driver may be required to undergo drug testing.
  5. Return-to-Duty Testing: CDL holders who have violated drug and alcohol regulations are required to complete a return-to-duty process, which includes a drug test before they can resume driving commercial vehicles.
  6. Follow-Up Testing: After returning to duty, CDL drivers are subject to unannounced follow-up testing as directed by a Substance Abuse Professional (SAP). The frequency and duration of follow-up testing are determined by the SAP.
  7. Types of Drugs Tested: Drug tests for CDL holders typically include screening for marijuana, cocaine, amphetamines, opioids (including heroin), and phencyclidine (PCP). Some tests may also include synthetic opioids like fentanyl.
  8. Alcohol Testing: In addition to drug testing, CDL holders are also subject to alcohol testing. This includes pre-employment testing, random testing, post-accident testing, and reasonable suspicion testing. The legal blood alcohol concentration (BAC) limit for CDL holders is typically lower than for non-commercial drivers.
  9. Testing Procedures: Drug and alcohol testing must be conducted according to specific procedures outlined in FMCSA regulations. Testing must be performed by qualified and certified personnel, and the samples must be analyzed by approved laboratories.
