Schools in Gauteng, North West, Mpumalanga, Limpopo and Free State open on Wednesday.

“For this month until the next announcement, we are saying schools will remain the same especially on the rotational timetable…The fact of the matter is that Covid-19 is still very much with us and we need to continue to work together to fight it.

Pretoria, South Africa, 24 August 2021: The number of children born to teen mothers in South Africa’s most populous province, Gauteng, has jumped 60% since the start of the COVID-19 pandemic, with Save the Children concerned for the well-being of both mothers and babies.

New figures from the Gauteng Department of Health show that more than 23,000 girls aged under 18 gave birth between April 2020 and March 2021 – of which 934 were aged under 14 - compared to 14,577 girls aged 19 and under having babies in the same period a year earlier.

Gauteng is home to more than 15 million people, a quarter of South Africa’s population, and includes the country's largest city, Johannesburg, and its administrative capital, Pretoria.

A suretyship agreement is defined as an agreement in terms of which a third party, namely the surety, undertakes liability towards a creditor for the proper performance of a portion of or the entire obligation of a debtor.

A valid principal obligation between the creditor and debtor is essential for the validity of a suretyship agreement. This is known as an accessory obligation. Therefore, if there is no principal obligation, then there is no suretyship agreement. It should be noted that the debtor’s obligation towards the creditor continues to exist notwithstanding the suretyship agreement.

Governments worldwide face the same dilemma: Do existing human rights prevent them from compelling their citizens by legislation to be vaccinated?

There is much uncertainty as to whether the Directions which were issued in June 2021 entitles South African employers to introduce mandatory vaccination at the workplace as the Bill of Rights states at section 12(2)(b) of the Constitution that “Everyone has the right to bodily and psychological integrity, which includes the right (b) to security in and control over their body.” In simple terms this means that people can refuse to be injected with the vaccine.

Does this mean that individual rights outweigh the rights of the employer and fellow employees to a safe and healthy workplace?
