CMS says it canceled about 315,000 unauthorized enrollments covering more than 760,000 people, with roughly $2.2 billion in taxpayer-funded subsidies at stake. The administration says some of the cases involve phantom enrollees, unauthorized sign-ups, questionable Social Security number use, and broker misconduct.

The episode also looks at findings from the Government Accountability Office, which reported that fictitious applicants were able to obtain subsidized Marketplace coverage during covert testing. GAO stressed that those test results are illustrative and cannot be generalized to the entire enrollee population.

Ra’ Sean also examines the other side of the enrollment decline: ACA participation has been affected by higher healthcare costs and the expiration of enhanced premium tax credits, meaning not every person leaving coverage is connected to fraud enforcement.

The legislation would formally establish the National Fraud Enforcement Division within the Department of Justice, an office already operating under Assistant Attorney General Colin M. McDonald, who became its first leader in April 2026.

The stakes are enormous. The Government Accountability Office estimates that federal fraud losses range from roughly $233 billion to $521 billion every year, based on data from fiscal years 2018 through 2022.

The DOJ has already pointed to major enforcement actions, including a nationwide healthcare fraud takedown in which 455 defendants were charged in alleged schemes involving more than $6.5 billion.
