En octubre Facebook experimentó un “apagón” que afectó tanto a la red social por excelencia como a sus subsidiarias (Messenger, WhatsApp, Instagram, etc.) generando pérdidas en los sistemas laborales de una gran cantidad de personas. Desconocemos si el “apagón” tuvo que ver con las denuncias contra el corporativo que por esos días se ventilaban o si más bien estuvo relacionado con los cambios que pronto anunciaría el CEO mientras paseaba por un entorno virtual: el renombramiento de su empresa como “Meta” en alusión directa al “metaverso” que a partir de ese momento se propuso encabezar: según el anuncio de Mark, migraremos a la “nueva realidad” tomados de su cálida mano… y comprando sus productos (una copia del video subtitulado aquí).
Ya habíamos visto cómo la evolución de internet —el salto a la “web 2.0”—, que parecía prometer democracia, autogestión, autoproducción y hasta libertad, quedó en manos de corporativos encabezados por Facebook. Hoy aparece un contexto similar mientras transitamos a la “web 3” bajo los términos de Facebook, Instagram o WhatsApp, aunque creamos que estamos participando en el diseño del futuro. Porque además, ese metaverso sobre cuyas carnes comienzan a caer las tarascadas de los corporativos, no es nuevo: ahí están las experiencias de Second Life, con casi dos décadas de vejez, o de Minecraft (aquí uno de muchísimos fansites), donde los y las usuarias amplían territorios virtuales. Ese metaverso que la Facebook transformada quiere encabezar no sólo no es nuevo, sino que arrastra vicios y condiciones de la realidad “real” y a partir de ahí provocará nuevas brechas en un mundo en que el acceso a las tecnologías digitales ni siquiera ha alcanzado a la mitad de la población global. Como dice Montserrat Álvarez en su artículo “Burbuja de soma (contra el zuckerverso)”:
“Del asiento somático del alma habló Platón en su Politeia porque incluso un creyente en la superioridad ontológica del mundo inteligible como Platón sabía que lo inmaterial descansa en la materia como su soporte, al menos en este mundo, que, para todos los efectos, es el real, así que el autismo grupal del “mundo feliz” en línea no eliminará —salvo en la fantasía de sus usuarios— las relaciones de clase históricamente constituidas, sino que las articulará —ya lo está haciendo— de un modo aún más perverso en el “siguiente nivel” del capitalismo, nivel espectral que para media humanidad deja fuera de cuadro uno de los polos del viejo y persistente antagonismo capital / trabajo. Las ondas expansivas de la historia seguirán ahí afuera, creciendo, porque no hay Alexa sin infraestructura, no hay Siri sin hacinamiento y precarización en fábricas, no hay inteligencia artificial sin trabajo esclavo ni inmaterialidad sin mano de obra: todo eso seguirá allí aunque dejes de verlo, y que dejes de verlo lo hará más terriblemente real aún, y te hablo en segunda persona porque la mayoría del público de los [podcasts] es, por desgracia, un público de clase media, esa clase eternamente embobada y presa en su burbuja de soma, para usar aquel neologismo acuñado por Huxley en su famoso libro de shakespeariano título que todos conocen y del que nadie aprende”.
Mientras tanto, acá en el universo real o NETAVERSO —como le dice Alx Rubio— nos han alcanzado las fiestas de fin de año, así que este podcast se tomará un descanso, se irá de vacaciones por la libre, y estará de vuelta en enero de 2022, ¡felices accesos!
Hace un par de semanas, Mariana Anzorena y Miguel Ángel Lara, dos grandes amigues y especialistas en estudios relacionados con los deportes, invitaron a las dos terceras partes onvres de #PorLaLibre (Alx y Charlie) a platicar en su podcast Sociedad Deporte sobre las relaciones entre el deporte y la música. Hoy nos ponemos a mano y tenemos las voces de Mariana y Miguel Ángel para conversar sobre acceso y deportes:
- acceso en términos de género: cómo el sesgo que discrimina a las mujeres se vuelve explícito en cuanto al deporte;
-acceso en términos de edad: cómo el deporte sufre de “juvenilización” en el discurso político;
- acceso en términos de infraestructura y servicios: cómo los gobiernos utilizan la necesaria inversión en infraestructura como moneda de cambio político, y cómo las divisiones clasistas de nuestras sociedades inciden en la configuración de la participación en el deporte organizado; cómo hay deportes para “el pueblo” y otros para poblaciones privilegiadas;
- acceso en términos de la capitalización del seguimiento que el resto de la sociedad hace a los deportes, sobre todo los profesionales, que poco a poco van siendo secuestrados por los grandes medios de comunicación.

“Si realmente quieres entender la música en nuestros días, aléjate del escenario y estudia a la audiencia” (Ted Gioia, Music. A Subversive History).
En este episodio número 12 de nuestra segunda temporada, en #PorLaLibre abordamos los derechos de las audiencias y para ello contamos con una invitada pionera en el asunto: Ana Cecilia Terrazas, quien, además de tener una trayectoria impresionante de trabajo por y para la radiodifusión en México, es hoy la defensora de las audiencias de Radio Educación. ¿Qué significa esto? ¿Qué derechos puede tener el público de un medio masivo de comunicación, en su relación con él? ¿Están legislados estos derechos y hasta dónde llega la normatividad al respecto? ¿Qué más podemos hacer?
Ana Cecilia nos cuenta un montón de cosas sobre estos temas: Ante la ausencia absoluta de poder del público cuando se enfrenta con el poder omnímodo del medio: las audiencias tenemos derechos. Hasta las redes sociales digitales, que parecían ofrecer cierta equidad en el flujo de la comunicación, mantienen a las audiencias en una posición que podríamos llamar subalterna respecto del poderoso corporativo que controla, si bien no ya los mensajes, sí los modos en que los nuevos públicos producen la información que consumen. Y Ana Cecilia nos aclara que los derechos de las audiencias pueden ser claros ante los viejos medios (radio y TV, el espectro radioeléctrico), pero no alcanzan a las nuevas plataformas, al streaming, a las redes y sus tendencias: hay mucho por hacer.
Aun en entornos de comunicación orientada a la supuesta transparencia del ejercicio gubernamental (las conferencias del presidente, por ejemplo), hay una lectura que nos permite ver cómo es la voz del poder la única que se escucha a través de ese espacio que supuestamente es de todes y que el Estado concesiona a gestores públicos y privados. Los derechos de las audiencias consisten, dice Ana Cecilia, en “intentar tener una relación menos desigual”. Pero también nos cuenta que la figura de defensoría de audiencias, como muchas otras relacionadas con derechos humanos, no es vinculante y su labor se encuentra por ahora reducida a la emisión de recomendaciones (además de que funciona en los medios públicos pero no tanto con los privados).

Dos “eventos” relacionados con los llamados derechos de propiedad intelectual surcaron las redes sociales la semana pasada: por un lado, un enorme corpus de fans del grupo surcoreano BTS, uno de los mayores fenómenos de la cultura popular mediática global de la última década, se enfrentó a Twitter y a la DMCA cuando la plataforma social, en respuesta a reclamos del policía de los contenidos, decidió retirar materiales elaborados por los y las fans —fanart— de esa banda que es mucho más que simple “K-Pop” (mira, por ejemplo, esto). La DMCA, acrónimo que Wikipedia traduce como Ley de Derechos de Autor de la Era Digital, es un recurso jurídico federal estadounidense que vigila “violaciones” en internet a los derechos de autor que dice proteger y permite a quienes violan esos derechos pasar el trance sin consecuencias si los contenidos transgresores son retirados de inmediato. El recurso jurídico es utilizado masivamente por plataformas como Twitter, Facebook, el buscador de Google y más que, ante un reclamo de la DMCA, ni siquiera preguntan: proceden a borrar el contenido “criminal” para quedar a salvo de consecuencias como las demandas por piratería. Pero en el caso que comentamos, un desarrollo ulterior permitió probar que la DMCA había secundado el reclamo procedente de un extraño grupo fascistoide y homofóbico (el “Team Copyright” presente en Facebook), que se autodesignó protector de la “propiedad intelectual” de otras personas, blandiendo un oscuro discurso de odio, y aprovechó que, dada la ausencia de consecuencias fiscales o penales, la DMCA no revisa los casos: procede al grito de denuncia y espera el inmediato retiro de lo que le ofende. ¿En qué acabó la historia? ¡Pasen a escuchar!

En los episodios 2 y 3 de esta segunda temporada de #PorLaLibre platicamos con Merarit Viera sobre la ruta plagada de obstáculos que tienen que recorrer las mujeres hacia la música, un mundo dominado por hombres. Siempre desde nuestra preocupación por el acceso democrático para todas las personas a todos los espacios de información, cultura y conocimiento, hoy iniciamos el análisis de otro de los ámbitos de formación, desarrollo y vida que durante siglos los hombres han bloqueado para las mujeres: la ciencia; más concretamente el dominio de lo que se conoce hoy como STEM (siglas en inglés para Ciencias, Tecnología, Ingenierías y Matemáticas), las anteriormente calificadas como “ciencias duras”, que no sólo son propiedad casi absoluta de hombres sino que además ellos experimentan desde un poder omnímodo que acosa, denigra e interrumpe incontables carreras científicas. A partir del documental Picture a Scientist, dirigido por Ian Cheney y Sharon Shattuck (2020, disponible en Netflix con el título en español Mujeres en la ciencia), en el que se narra el acoso sistemático, la discriminación por género y origen étnico, y la epopeya que tienen que vivir las mujeres para desarrollarse como científicas, comenzamos a analizar esta situación y a esbozar caminos de salida como los que representa el Movimiento STEM (un interesante ensayo de María José Olivera Mazzini sobre esta problemática, a partir del documental, se puede encontrar en https://ladiaria.com.uy/feminismos/articulo/2021/7/acoso-racismo-estructural-y-sesgos-de-genero-en-la-practica-cientifica/). El documental enfatiza el sesgo de género implícito en nuestros acercamientos a las ciencias, por el que culturalmente las identificamos con hombres blancos y que genera un caldo de cultivo capaz de forzar a las niñas a autopercibirse como incapaces para aproximarse a ellas. Mientras buscamos que las mujeres científicas no sean “excepciones” de una ignominiosa regla que les bloquea el camino, pasamos revista a algunos casos, como el de Ada Lovelace, matemática británica que legó importantes hallazgos para el mundo de la programación, y bajo cuyo nombre se ha echado a andar un programa de visibilización y aliento a la participación de las mujeres en el mundo STEM: Finding Ada, así como otras visiones desde el mundo de la ficción al contexto adverso que enfrentan las mujeres en la academia, como la serie La directora (The Chair, 2021, también disponible en Netflix). Continuamos con la conversación en torno de la perspectiva de derechos con Lorena Loeza: ¿Cómo entendemos el acceso en el marco de los derechos? ¿En qué condiciones se da el acceso a la educación o a la salud que garantizan nuestras Constituciones políticas? ¿Cuentan los Estados con los elementos necesarios para garantizar nuestros derechos? Lore nos explica que hay en la garantía de un derecho: accesibilidad, calidad, no discriminación. En este sentido, enfrentamos barreras en el acceso a los derechos, desde económicas hasta condiciones estructurales, culturales y mucho más. Hablar de “acceso universal” es mucho más que simplemente abrir una puerta para todas las personas; pasa por la inversión social necesaria para garantizar efectivamente nuestros derechos más allá de la mera prestación de servicios.
Uno de los problemas que actúan en contra del ejercicio pleno de nuestros derechos es la desigualdad, “expresión material de la discriminación”, en palabras de Lorena. En el contexto de la pandemia, el acceso a la información por la vía digital se ha vuelto un elemento casi obligatorio y puede incluso dar la impresión de que la sociedad ha dado un viraje hacia la interconexión, pero es una ilusión que puede hacernos olvidar que existen grandes grupos de población para los que ese acceso no está garantizado y, por tanto, quedan excluidos de lo que para la sociedad “conectada” parece un derecho natural: Lore se pregunta: “¿Realmente tenemos mayor información y esa información de verdad nos sirve para tomar decisiones que tienen que ver con el acceso a derechos?”.
Y en cuanto a la tensión entre los derechos de acceso y los derivados de las actuales políticas de protección a la propiedad intelectual y creativa —nuestra vieja polémica según la cual los derechos de autor bloquean el derecho universal de acceso a la información, el conocimiento y la cultura—, Lore opina (y le hacemos eco) que en algún punto los polos de esta relación tendrán que flexibilizar sus posiciones, así como diseñar medios de distribución y producción capaces de buscar el acceso a la par que la protección y el incentivo a la creación: “el creador tiene tanto derecho a recibir una remuneración” como el resto de las personas a acceder a ella. Nuevamente citamos a Lessig y la necesidad de replantear la ley. Lore nos plantea una arista más de esta polémica: en el mundo de la gran industria cultural y sus medios de protección, el esquema vigente no solo cierra puertas al acceso sino que también bloquea la posibilidad de desarrollo de otras expresiones culturales. Y queda abierta la puerta para evaluar los esquemas alternativos de protección de derechos creativos que representan las propuestas de Creative Commons (su portal tiene un sabroso catálogo).
Y Lore, que es también una gran crítica de cine, recomienda:
- Filmin Latino, plataforma de cine independiente (https://www.filminlatino.mx/)
- La TV abierta en México (canal 22 [https://canal22.org.mx/], canal 14 [http://www.canalcatorce.tv/?c=EnLinea]) que programa cine que no se veía desde hace tiempo. Y añadimos la peruana que también tiene sorpresas [https://www.tvperu.gob.pe/play], aunque estas plataformas nacionales suelen no estar disponibles más allá de las fronteras de sus países.
- Amazon puede ser también una opción; su oferta es atractiva.
- E, insistimos, las estrategias de desobediencia civil presentes en la torrentería y la blogosfera siguen ahí.
Conversamos con Lorena Loeza, maestra, socióloga, especialista en derechos humanos y gran crítica de cine, sobre la perspectiva de derechos para incorporarla a nuestra reflexión sobre el acceso, el conocimiento y la cultura. La perspectiva de derechos construye colectivamente una narrativa acerca de la dignidad de las personas y de las cosas a las que podemos o no tener derechos por el solo hecho de ser humanos y humanas. Como narrativa en proceso permanente de construcción, la perspectiva de los derechos humanos ha ido incluyendo nuevos elementos, como aquellos relacionados con fomas de discriminación (desde el género y la diversidad sexual hasta lo que hoy describimos como derechos socioambientales). No se refiere exclusivamente al ámbito de las leyes, sino que se trata de una cultura que excede lo jurídico —aunque su dimensión jurídica es precisamente lo que los hace exigibles— y piensa, entre muchas otras cosas, que no existen motivos para excluir o discriminar personas de las cosas a las que tienen derecho. ¿Y en cuanto a la cultura? Es un derecho humano, pero tiene límites tan imprecisos como las definiciones que podamos dar de “cultura” y enfrenta los debates alededor de qué es “legítimamente” o “auténticamente” cultura, así como qué derechos tenemos sobre ella (sobre las construcciones colectivas que carecen de autor tanto como sobre la obra de los y las creadoras). En relación con la cultura, en la perspectiva de derechos humanos es central que podamos observar, proteger y alentar el desarrollo tanto de los productos independientes de la creatividad humana, como de aquellos que se originan en la poderosa estructura de los grandes medios; es central discutir aquí el balance entre el derecho que tienen los y las creadoras a vivir de su trabajo, como el derecho que las audiencias tienen a conocer, consumir y transformar esas creaciones. Nos dice Lore; “Sí existe un derecho a tener acceso a cualquiera de las manifestaciones culturales que se producen y también a producirlas”. El derecho humano a la educación juega aquí un papel fundamental, así como los de libertad de expresión y manifestación, ¿cómo hacer para armonizar todo esto, para construir una cultura de los derechos humanos? ¡Escuchen a Lorena Loeza en este episodio de #PorLaLibre! Hace algunas semanas, Cabeza de Moog difundió pormenores de la controversia sobre el Concierto argentino de Alberto Ginastera (https://cabezademoog.blogspot.com/2021/09/la-obra-de-alberto-ginastera-que-no-se.html); una obra que podría ubicarse en el espíritu postromántico nacionalista (como las Bachianas de Villalobos o el Huapango de Moncayo), que sin embargo no puede ser interpretada por músicos y músicas argentinas pues los derechos sobre ella fueron vendidos a una pianista estadounidense que cobra una fortuna por permitir su ejecución (además, sin derecho a grabarla). Desde un punto de vista nacionalista suena absurdo; incluso se habla en Buenos Aires de iniciar un proceso de declaración de dicho concierto como patrimonio cultural de la nación, pero los derechos están siendo protegidos por la legislación estadounidense, y ahí no hay modo de ganar. La extraña controversia pone en la mesa los desfases existentes entre las legislaciones de diferentes países en el contexto de una esfera de distribución y consumo que es en realidad global.
Hace más o menos las mismas semanas, la plataforma Ibermúsicas y el Instituto Nacional de la Música (organización pública no estatal argentina) publicaron un Manual interamericano de derechos intelectuales en la música (de descarga libre http://ibermusicas.org/index.php/se-lanzo-el-manual-iberoamericano-de-derechos-intelectuales-en-la-musica/) para apoyar a músicos y músicas en el manejo de lo relacionado con derechos de autor y propiedad intelectual. Ahí se explica que los paradigmas legales de los Estados Unidos y los países latinoamericanos son diferentes; que la aproximación del derecho autoral entre nosotros es “humanista” pues garantiza la propiedad moral de una obra a su autor independientemente de los avatares del mercado, mientras la estadounidense se orienta exclusivamente a lo comercial. Pero el texto del INAMU da por sentada la legislación actual sin perspectivas de discusión y además asevera que la propiedad autoral es “aún más legítima que cualquier otra forma de propiedad”, un gazapo con el que ni siquiera Lawrence Lessig, antianarquista confeso, estaría de acuerdo: la caducidad de los derechos de copia existe, dice Lessig, porque el paso de los elementos de la cultura al dominio público es un incentivo y un catalizador de nueva producción cultural, es decir, un beneficio social general.
Entre estos dos eventos, esta semana #Porlalibre aborda las barreras y obstáculos que residen en las diversas leyes nacionales y que entorpecen no sólo la creación de nueva cultura —el progreso mismo— sino, especialmente, el derecho humano de acceso al conocimiento. En la “sociedad de la información” los progresos técnicos, las tecnologías transformadoras, los usos nuevos interrogan a los derechos de propiedad intelectual desde otros lados, específicamente desde los derechos de acceso, los derechos sociales. Y la legislación responde con control en lugar de intentar adaptarse a los cambios. ¿Hasta dónde las legislaciones contribuyen o frenan las nuevas prácticas (y por tanto el progreso, la distribución del conocimiento)? ¿Hasta dónde debería llegar la legislación? Esta semana platicamos sobre el concepto que está en el corazón de todos los debates sobre propiedad intelectual: remix. Comentamos el trabajo de un autor que ha dedicado sistemática atención crítica a estas problemáticas (sin salirse mucho del ámbito jurídico), Lawrence Lessig [https://lessig.org/], que en sus libros Free Culture y Remix, entre otros medios, ha desmenuzado los orígenes, sentidos y significados, ventajas y desventajas, opciones y posibilidades de la legislación de los Estados Unidos (que se impone cada vez más como modelo global) sobre los derechos relacionados con la propiedad intelectual. Su tesis es esencialmente que toda cultura es remezcla, y que el papel de la regulación en el aliento a la innovación y la creatividad puede verse revertido hasta convertirse en su principal obstáculo (si se permite que grandes grupos de poder influyan en las decisiones judiciales).
Las transformaciones culturales provocadas por la aparición de tecnologías que permiten a los usuarios manipular contenidos preexistentes, y su cruce con la cultura emergente que expresa la incontenible vitalidad de los sectores marginales de la sociedad estadounidense, han puesto en jaque a la ley de una forma aún más dramática que sus antecesoras (inventos como el fonógrafo, la radio, los audio y videocassettes, la TV por cable). DJs como artistas, audiencias como protagonistas activas, música grabada como insumo para la transformación cultural: una combinación que se da sin pausa desde los años 70, pero que los grandes intereses económicos que monopolizan los “contenidos” objetan y persiguen mediante una millonaria industria de la demanda contra presuntos usos ilegales. Pero nada detiene el remix; algunos ejemplos:
→ Vocaloid, el robot que canta y que ha producido toda una cultura de reinterpretación por los y las fans.
→ Acercamientos a la remezcla surgidos en México como Nortec Collective (link a presentación de Nortec en el festival Quimera 2020).
→ El mash-up: Girl Talk, proyecto del artista y DJ Gregg Gillis, pionero de esta técnica de remezcla que consiste en fusionar contenidos preexistentes (el link incluye descargas libres!).
→ “The Wellerman” y Tiktok, intervención en cadena (Remix de Argules en YT).
→ DNA, Suzanne Vega y Tom’s Album. Nuestra reseña en Cabeza de Moog (si conocen el blog, saben dónde encontrar el disco en alta resolución), y el reciente mashup salsero de esa canción detonante.
→ La cultura es remix; incluso la gran industria se beneficia —sin costo— de la producción de fans (el “fandom” o dominio de los aficionados; fanzines, fan-fiction, fanart, etc.); el ejemplo de la serie 24 (Surnow y Cochran, 2001-2010) es abrumador, aquí una de sus “fandom wiki”.
Finalmente, recomendamos el documental Copyright Criminals que relata el surgimiento del sampleo y la forma en que la industria lo criminalizó desde sus inicios (y que incluye opiniones de Lessig), y recordamos que para Lessig hay tres tareas por realizar: 1. detener a los fanáticos del control; 2. apoyar a los que colaboran en la difusión, 3: redescubrir los límites de la regulación (revisar la ley).
