As Justice Thomas wrote in Wednesday's, July 8, 2020 Supreme Court decision, “For over 150 years, the Little Sisters have engaged in faithful service and sacrifice, motivated by a religious calling to surrender all for the sake of their brother.”

After the Obama Administration decided to force nuns and other religious believers to violate their conscience in the service of a leftist agenda or pay heavy, crippling fines, the Trump Administration changed the rules to give an exemption to the nuns and others similarly situated.

This outraged the Attorneys General of Pennsylvania and New Jersey and, we now know, Justices Ruth Bader Ginsberg and Justice Sonia Sotomayor.

As Justice Samuel Alito wrote, “Nothing short of capitulation on the part of the Little Sisters would suffice,” for these leftist activists. Thankfully, the Supreme Court ruled 7-2 in favor of the Little Sisters, but I predict this is not over.

Attacks against the Second Amendment are unremitting. A new attack strategy seeks to repeal statewide protections for law-abiding citizens to exercise their second amendment rights and focus on passing more meaningless restrictions at the local level. One of these meaningless and probably harmful gestures just took effect in the City of Alexandria, Virginia, this month.

After the liberal controlled state legislature and governor of Virginia reversed strong firearm preemption laws, the City Council of Alexandria wasted no time to limit citizen’s Second Amendment rights in their jurisdiction. They canned guns, ammunition and components from city buildings, parks, recreation centers, community centers and streets and sidewalks near so-called “special events.”

This is a failure of government, a failure of the mainstream media, and a failure of the voters. Let me explain why.

Can state electors cast their votes for whomever they chose in a presidential election? We witnessed several electors do just that in 2016, in an effort to deny Donald Trump his hard won victory by throwing the presidential election into the House of Representatives. On Monday, the US Supreme Court ruled 9-0 that states can punish electors who abandon their duties and try to game the system. This ruling supports our Electoral College system, and arrives just in time to discourage “faithless” electors in the 2020 presidential election.

By a slim margin of 5 to 4, the Supreme Court struck down a state law that banned state aid to religious schools. This decision shows a respect for the long-neglected First Amendment of religious rights. Justice Thomas rightly noted that Supreme Court decisions in the 20th century went too far, bordering on religious hostility and hampering the free exercise of our rights.

The liberal NPR recently interviewed Attorney General Bill Barr and asked him typically biased questions, but he had them on the defensive as he spit facts back at the interviewer. Barr doesn't let the media mob, the Left nor the Democrats bully him and he is a great pick by President Trump to defend our Constitution. . . . . . In the 20th century, our form of free society faced a severe test.

There had always been the question whether a democracy so solicitous of individual freedom could stand up against a regimented totalitarian state.

That question was answered with a resounding “yes” as the United States stood up against and defeated, first fascism, and then communism.

But in the 21st century, we face an entirely different kind of challenge.

The challenge we face is precisely what the Founding Fathers foresaw would be our supreme test as a free society.

They never thought the main danger to the republic came from external foes. The central question was whether, over the long haul, we could handle freedom. The question was whether the citizens in such a free society could maintain the moral discipline and virtue necessary for the survival of free institutions.

By and large, the Founding generation’s view of human nature was drawn from the classical Christian tradition.

These practical statesmen understood that individuals, while having the potential for great good, also had the capacity for great evil.

Men are subject to powerful passions and appetites, and, if unrestrained, are capable of ruthlessly riding roughshod over their neighbors and the community at large.

No society can exist without some means for restraining individual rapacity.

But, if you rely on the coercive power of government to impose restraints, this will inevitably lead to a government that is too controlling, and you will end up with no liberty, just tyranny.

On the other hand, unless you have some effective restraint, you end up with something equally dangerous – licentiousness – the unbridled pursuit of personal appetites at the expense of the common good. This is just another form of tyranny – where the individual is enslaved by his appetites, and the possibility of any healthy community life crumbles.

Edmund Burke summed up this point in his typically colorful language:

“Men are qualified for civil liberty, in exact proportion to their disposition to put chains upon their appetites.... Society cannot exist unless a controlling power be placed somewhere; and the less of it there is within, the more there must be without. It is ordained in the eternal constitution of things that men of intemperate minds cannot be free. Their passions forge their fetters.”

So the Founders decided to take a gamble. They called it a great experiment.

They would leave “the People” broad liberty, limit the coercive power of the government, and place their trust in self-discipline and the virtue of the American people.

In the words of Madison, “We have staked our future on the ability of each of us to govern ourselves…”

This is really what was meant by “self-government.” It did not mean primarily the mechanics by which we select a representative legislative body. It referred to the capacity of each individual to restrain and govern themselves. . . .

The Trump Administration won at the Supreme Court yesterday when the court decided by 7 votes to 2 votes to deny review of the asylum request of a Sri Lankan who was arrested 25 yards away from the US border after illegally entering the US. This should have been a unanimous decision but, of course, it was not.

How is the Left taking this decision? They are not taking their defeat well. They believe that sympathetic facts should drive courts to ignore the black letter of the law and implement their policy preferences from the bench. Let’s dig into this case.
