Want to know which compliance areas impact the FMCSA's safety fitness standard? Look no further! The standard is determined through a Compliance Review (CR) and the specific areas of compliance are outlined in §385.5.
During an audit, you'll need to produce various records, including proof of financial responsibility, driver qualification files, drug and alcohol testing records (if applicable), hours-of-service records, vehicle inspection and maintenance records, hazardous materials records (if applicable), and an accident register with supporting documents.
Enforcement will also take a close look at your safety management controls. These controls are the systems and processes you have in place to ensure that your safety program is effective. An auditor would expect to see records related to training, policies, and procedures, as well as mechanisms to monitor and track compliance. If any breakdowns in safety efforts are revealed, the FMCSA would expect to see documented corrective actions.
In addition, your safety rating is influenced by your accident rate and vehicle out-of-service (OOS) rate. The accident rate is determined by the number of recordable accidents per million miles over the past 12 months. The OOS rate is derived from vehicle inspections conducted during the same period. To pass, your OOS rate must be less than 34 percent.
The results of your CR will lead to one of three safety ratings: satisfactory, conditional, or unsatisfactory. A satisfactory rating means that you have functioning and adequate safety management controls in place. A conditional rating indicates that your safety management controls are inadequate, but you can continue to operate while resolving the deficiencies identified by the FMCSA. An unsatisfactory rating means that your safety management controls are inadequate and your fleet cannot continue operating.
If your organization has never had a CR, your fleet will be unrated on the SAFER website.
So, how do you find out your DOT safety rating? It's easy! Just head over to the FMCSA's SAFER website. Remember, your safety rating is available to the general public, so maintaining a good rating is crucial for your company's reputation, insurance rates, and driver recruiting efforts but keeping a clean drug free workplace.
We offer full trucking authority packages to make the launching of your trucking company business go more smoothly. The Department of Transportation regulates safety so doing it right in the begging is very important.
