  • 081: The Engineers I’m Recruiting Want H-1B Transfers and Green Cards… What Do I Do?

    In this week’s Immigration Law for Tech Startups podcast, I’ll discuss how to hire people on H-1B. There is a severe shortage of engineers in Silicon Valley right now. Our phone has been ringing off the hook and we've been getting so many email inquiries from CEOs, HR folks, recruiters, and other people who are hiring rapidly. And these scaling technology companies are frustrated and confused because they're not able to fill their companies as quickly as they would like to, especially after receiving a funding round. 

     

    The landscape has changed very quickly for hiring in the last several months. At the beginning of COVID, our conversations were around what if they had to lay somebody off. Now, those have transitioned into how they could hire 100 engineers in the United States within the next 12 months because they don't know where to find qualified people to fill those roles.

She is joined by Lanie Denslow, a cultural competence and business protocol consultant who founded World Wise Intercultural Training & Resources in 2000 to help professionals successfully navigate the cultural differences that emerge in today's complex, fast-moving and global business environment. 

    Today, learn about how culture shows up in people’s behavior and how you can build your cultural competence. One of those small cultural things that are easy to create are misunderstandings. You could end up insulting someone without you knowing it, or the other way around.

     

    Cultural competence is about understanding that there are different cultures and that behaviors are influenced by culture, which hopefully leads to a better understanding of other people’s cultures. As a result, you’re able to build better relationships and interaction with other people, whether they're your colleagues or your clients.

  • 078: Parole Entry Process

    In this week’s Immigration Law for Tech Startups podcast, we're going to talk about how to enter the United States using the new immigration status for startup founders called International Entrepreneur Parole – what it is, how it works, and what to expect. 

     

    For the first time in decades, the United States actually has a new immigration pathway, which directly supports our community here at Immigration Law for Tech Startups. It's practically a new immigration status in the United States. It’s not a visa nor a green card. It's not citizenship – but it's another type of United States immigration program, specifically, for people who have founded tech companies that are going to scale rapidly and now have this pathway to come here.

     

    Keep in mind this is a novel program so it’s going to be evolving. We will continue to give you updates as we usher people through and as we generate more ideas around its variations and combinations as well as how to make it work in different situations.

    In this week’s Immigration Law for Tech Startups podcast, I’m excited to have Edward Gorbis join me as we discuss some practical mental tips and practices to help you develop an unbreakable mindset geared towards success.

     

    Edward is a performance coach, a startup advisor, a keynote speaker and an author. Born in Ukraine, his family immigrated to the United States (with a little stopover in Israel prior to coming to the U.S.). For most immigrant families, they want their kids to become either a doctor, a lawyer, or an engineer – Edward chose the latter. Once he had reached a level of stability, he realized he wasn’t aligned as an engineer, and so, he transitioned into the coaching world. 

     

    Edward is the founder of Career Meets World, a leadership coaching platform that helps immigrants and first generation professionals thrive in their careers and life.   • 075: Latest Biden Immigration Updates

    In this week’s Immigration Law for Tech Startups podcast, I’ll discuss the latest immigration changes under the Biden administration. In Biden’s first 100 days in office, there have been some meaningful changes in immigration for startups, founders, investors, researchers, highly skilled professionals, students, Dreamers, and families under his administration.

     

    Firstly, the Biden administration has ended some Trump era policies such as the Muslim ban, the banning of the public charge rule, as well as the working visa bans, specifically on H1-B visas, J visas, and L visas. Biden has allowed many of these rules to lapse. Notably, green card processing is back on at U.S. embassies and consulates around the world (which is great news!) 

     

    There have been many changes that will definitely benefit families, asylum seekers and people in removal proceedings. This has been the main focus of the administration. Although not so much on the business side, we are still starting to see positive changes in business immigration as well.

  • 074: Diversity Immigrant Visa Program

    In this week’s Immigration Law for Tech Startups podcast, my partner, Anita Koumriqian, is joining us today as we discuss the annual Green Card Lottery called Diversity Visas. 

     

    Under the diversity immigrant visa program, 50,000 green cards are made available each year to people who are born in countries that have lower rates of immigration in the U.S. Similar to the H1-B lottery, it's a pure random online lottery, but anybody can apply for it as long as their country is eligible. 

     

    Diversity green card candidates may apply either while residing outside the U.S. or while residing in the U.S. If you're outside of the U.S., you go through the consular process. And if you're in the United States, you can file the green card with USCIS as an adjustment of status, just like how all other green card applications are.

    This is fantastic, incredible news for startup founders around the world. Whether you're in the U.S. or not, whether you've ever had an H1-B, working visa, or student F1 visa or not – it doesn't matter – you can still qualify for this program if you meet the requirements. 

    The International Entrepreneur Parole is not a visa. It’s not a green card. The way the law is written is very flexible. They want to support international startup founders to build companies because they know this is a job creation engine for the United States. We all know our economy has hit some bumps in the road with COVID, and so anything we can do to create jobs would be beneficial for this program, our country, and the world.

  • 072: Special Visas for Talent from Specific Countries

    In this week’s Immigration Law for Tech Startups podcast, I’ll discuss five work visas specifically for international talent from certain countries: 

    • H-1B1 visa for Chileans and Singaporeans in specialty occupations
    • E-1 visa for treaty traders
    • E-2 visa for treaty investors
    • E-3 visa for specialty occupation professionals from Australia
    • TN (Treaty National) visa for Canadians and Mexicans

     

    All five of these visas require an employer sponsor and are the result of special trade treaties between the United States and specific countries. To qualify for any of these visas, the candidate must be a citizen of the country specified. Unlike green cards, in which your country of birth matters in determining your place in line for a green card, these visas only require you to be a citizen of the country.

     

    Depending on your citizenship or who you want to hire, these specialized—and rarely used compared to the H-1B, L-1, and O-1—visas offer a relatively quick way to come to or bring international talent to work in the U.S.
