Derek Chauvin Trial - Day 14 of Arguments: Thursday, April 15th
Derek Chauvin spoke in court first this morning before the jury was brought in, answering questions by Judge Cahill in regards to testifying. Ultimately, he decided not to testify, and the defense rested its case.
The prosecution announced new evidence had been found by Medical Examiner Andrew Baker. While watching the testimony of defense expert David Fowler, Baker said he found a report of George Floyd's blood gas reading from May 25, 2020. Fowler had presented a slide during his testimony in regards to carbon monoxide playing a role in the death of GF, saying that his Carboxyhemoglobin increased anywhere from 10-18%. The state said they had subpoenaed all records from Hennepin County Medical Center, but somehow this evidence was missed until Baker brought it to their attention on yesterday during Fowler's testimony.
The defense argued evidence was not given to defense until 7:53am this morning, and that the state knew Fowler was coming to present his testimony on Carbon Monoxide and therefore had ample time to find such evidence and prepare accordingly. Defense counsel Nelson mentioned that Dr. Fowler was unreachable on a plane home, and they still only contend that the Carbon Monoxide was only a contributing factor, not the cause of GF's death.
In the end, Cahill ruled that the blood gas readings would NOT be admitted and while Dr. Tobin would be allowed to take the stand again to rebut Fowler's testimony, he was not to reference or mention the new evidence, and if he did; the judge would declare a mistrial right then and there and we would start this process all over again from the beginning.
Dr. Martin Tobin took the stand to challenge the testimony presented yesterday by the defense by way of Dr. Fowler that the compound Carboxyhemoglobin had increased in GF 10-18% due to carbon monoxide exposure.
Dr. Tobin said he the defense was flat out wrong on the 10-18% increase in Carboxyhemoglobin, saying that GF's hemoglobin saturation, meaning how much the hemoglobin was saturated with oxygen, was 98%. So at MAX, there was 2% of Carboxyhemoglobin and the average human regularly has anywhere from 0-3% at any given time naturally.
The state then challenged the shade thrown by Fowler yesterday on my hero here Dr. Tobin. Yesterday, Fowler had said that he could find "NO LITERATURE ANYWHERE" to support Dr. Tobin's testimony that decreasing the size of the lungs, also decreases the size of the hypopharnyx. proceeded to tell the jury that there is extensive research in that.
And then under cross, my main man Dr. Tobin is asked if he had any of these studies and if he provided them to counsel and he comes back with a smirk/chuckle and says there are at least a dozen to 20, including on PubMed (published med. journal), as well as some in his report he completed for the prosecution, offering to .... "NAME THEM ALL IF YOU'D LIKE"...... lmaoooooo hahah I love this man!DEFENSE - NO FURTHER QUESTIONS AND THAT IS THAT!
BOTH THE STATE AND DEFENSE RESTS. Closing arguments and then jury deliberation will happen Monday.
