On November 4, the Supreme Court of Hawaii released its decision in League of Women Voters v. State. The decision was a huge step in the right direction. But will it get rid of all gut-and-replaces and eliminate Frankenbills (where pieces of dead bills get new life by stuffing them into tangentially related other bills with a suitable title)? Probably not. Amendments are still allowed. A person challenging a bill still needs to prove beyond a reasonable doubt that the bill is unconstitutional. And remember, it took a 3-2 vote to hold that recidivism and hurricane shelters are unrelated. The standard the court seems to be adopting is “whether the amendments and the original bill constitute a unifying scheme to accomplish a single purpose.” Determining what is or is not germane is not going to be easy in most cases.

President Clinton had a sign on his desk that stated, "It's the economy, stupid." That's still true today, however to win the 2022 mid-term elections it will also require passing bills that benefit everyday working Americans (Covid-19 Stimulus and the Infrastructure is a good start). And the social infrastructure bill. However, Democrats can't stop there. They will need to answer and defend attacks from the GOP on a wide range of ginned up cultural issues that attract the passions of Trump voters. Critical Race Theory in school vaccine mandates, defund the police, Second Ammendment rights are just a few that Democrats will need to address and ensure they are not defined by those false flag issues. Aggressive messaging is required from Democrat candidates to win the 2022 election, and it's not for the faint of heart to do it. Failure is not an option.
