What Is Broker Authority

Broker authority, often referred to as broker's authority or "freight broker authority," is a legal designation or certification required for individuals or companies that want to operate as freight brokers or property brokers in the United States. Freight brokers play a crucial role in the transportation and logistics industry by connecting shippers (those who need to transport goods) with carriers (truck drivers or transportation companies) to facilitate the movement of goods.

To obtain broker authority, individuals or companies must go through a regulatory process administered by the Federal Motor Carrier Safety Administration (FMCSA), which is part of the U.S. Department of Transportation. This process includes several steps:

  1. Application: The first step is to submit an application for broker authority to the FMCSA. This application includes information about the applicant's business, such as its legal structure, contact information, and details about its operations.
  2. Proof of Insurance: Applicants must also provide proof of a surety bond or trust fund agreement. This is a financial requirement to ensure that brokers can cover any potential liabilities or claims in case of disputes or failures in the transportation process.
  3. Payment of Fees: There are fees associated with obtaining broker authority, including an application fee and a processing fee.
  4. Designation of Process Agent: Brokers are required to designate a process agent in each state where they operate. The process agent is responsible for accepting legal documents on behalf of the broker.
  5. Background Check: The FMCSA conducts a background check on the applicant and any relevant individuals associated with the brokerage to ensure they meet the agency's fitness standards.
  6. Approval: If the application is complete and meets all the requirements, the FMCSA will approve the broker authority. The broker will receive a unique Motor Carrier (MC) number.

Once a broker obtains authority, they are legally authorized to broker freight and facilitate the transportation of goods between shippers and carriers. They must also comply with various regulations and maintain certain records related to their transactions.
