Sam Bankman-Fried.
With his life in front of him.
• He has a minimum 10 Million in legal fees, but he is facing a strong DOJ
• They have Very deep financial Pockets
• He has given close to 1000 phone interviews.
• He has ignored the judge's orders – which has countered anything good his attorneys could do
• And if his attorneys had given him any hope of winning at trial (the odds now are under 1.9%), those odds are now closer to zero
His new accommodations will be a far cry from his parent’s home on the Stanford University campus in Palo Alto, California,
District Judge Lewis Kaplan found probable cause to believe Bankman-Fried engaged in witness tampering.
Bankman-Fried already faces a litany of criminal charges
Coincidentally, sex trafficker and former British socialite Ghislaine Maxwell were also represented by Bankman Fried’s current attorney, Mark S. Cohen.
As I have previously mentioned, the Dept of Justice has a 98% conviction rate, and he has done everything to make his position in front of his Judge unattainable,
• Creating multiple terrible 1st impressions with the court
• Not being grateful for the opportunity to remain at his parent's home until sentencing.
• Repeatedly going against the orders of the court, his pretrial officers, and his attorneys by giving 100-1000 phone interviews with the press – each of which can be used against him
o With each publication benefiting financially each time they publish
• His attorney, previously defending Ms. Maxwell, I am confident realizes that the DOJ wins at trial, and yet Bankman-Fried is not doing anything to help himself
o Contrary to that – it’s as if he wants to be found guilty
o MDC Brooklyn is a horrible place to start
o I can only hope that his legal team will at some point encourage him to consider his life, and how he wound destroying not only his life, and his family but the lives of all of his victims who lost their life savings in FTX – this cannot be everyone else’s fault
At some point maybe he’ll be able to self-reflect and write his Story/Autobiography/NARRATIVE, where he accepts responsibility as CEO
Next could come a Release Plan. Hopefully, the judge gives him less than 45 years because he’s only in his 30s, and still has a lot to offer
Next, I am neither for nor against Former President Trump, rather, this is my satellite view of the COURT's Expectations,
MY TAKEAWAYS
For most judges, the key questions they want to be answered are:
1. Why did you do, what you did?
2. What have you done to own your mistake and demonstrate sincere remorse?
3. Why was the behavior out of character with an otherwise law-abiding life if it was?
4. Why are you unlikely to do it again?
5. Why should I cut you a break?
Make sure you have Truthtellers✨to support you.
1. We All Make Mistakes
2. Don’t forget: this is your chance.
3. Those around you should bring out something Positive in you.
3. This is your autobiography of your life, the good – the bad, and the ugly.
4. Enablers may make you feel good for that moment – but will not 👎🏻 be helpful in the long run. The NARRATIVE is your explanation without excuses, where you have accepted responsibility⚖️ and have remorse for the pain you have caused, while not minimizing what has happened.
Attorneys know the law, but the Nuances of Federal Prison are much different.
Before your Presentence Interview, you need to know:
WHO AND WHAT ARE YOUR STAKEHOLDERS?
WHAT IS A;
1. PERSONAL NARRATIVE –
2. ALLOCUTION –
3. RELEASE PLAN –
