In this rule, the customer is always right. The customer online... they have all the power, you have no power. It's that simple.

So it's not a question of right or wrong, it is what's gonna cost you the minimum amount of damage. That's it!

If there's a problem with the product, just give them their money back. Let them keep it. That's what you do or ask them what they need to be happy or make it right.

It's not worth the fight. Just give them their money back.

Look, don't get too complicated at this point. Just find your product, import and sell it first as your main protocol. I know we talked about getting an extra bit of a commission doing it that way. If this is stopping you and bothering you, then just jump in and then start making some money by buying some products.

Katherine asks, "Brendan, how long can the products be listed on Amazon before you sell?"

As soon as they are listed and they are in stock, you can sell it immediately.

"What time frame did they give you to get your product to your warehouse?"

Katherine is asking how the logistics work.

So you can list it whenever you want. You don't even need to have it in stock.

But then you can say that it's a good idea because Amazon will approve your listing and you know that the products are actually allowed to be sold.

Most people will buy the product then put it in Amazon then find out it's not allowed. The trick is to list first.

In places like eBay, you have to be in stock to list it. In Amazon, you don't. You can just say out of stock.

So there is really no time frame. You can just send it to Amazon and you can sell it whenever you like. So there is no issue there.

Look, the short answer is that I've imported for 17 years. I've never wanted anyone to come and sue me for the patent. But then again, I never had too much product on hand anytime, I just have enough to sell.

So bring it in and if you are infringing patent usually what happens is you get a ceased and deceased. As long as you not doing knowingly, you should be okay. You need to get legal advice on this.

But my finding is that if you know, you're ripping someone else's brand name or their patent you will be get caught, you deserve to get caught.

Next is from Clive, "I know that lithium-ion batteries are no good for importers. Are there other items to avoid? Can we get a list that is possibly updated on a regular basis?"

Are there items to avoid?

I would say honestly at the very start, anything that has too many moving parts. Anything with a lot of transistors or electronic parts are generally quite difficult. Avoid anything with chemicals in them.

Generally, for the start to avoid foodstuffs that are ingestible until you got a bit of a hang in the business. Anything that can give you the opportunity to get you sued, stay away from it.

Also stay away from products that have a low ticket. Items that you can't sell more than $20 on Amazon. I would stay away from items that are bulky.

These will generally be my rules of items to stay away from.

"When listing your product on Amazon or eBay or any other website, can you get in trouble by using other people brand names? The context I mean is for example if you are selling a storage container, can you say for example that this is perfect for storing Barbie dolls in or Lego in and then also use a picture of your item with Barbies in it to show how it is perfect for that or the legos etc. Or by saying the product you are selling would be great to assist gamers and then using the name of a couple of specific, current, trending games in the title and marketing of your product. Can you leverage the marketing of your products off the current trends by using their names in your marketing without getting into trouble?"

That is an excellent question. So the actual would be, ask a lawyer is my official advice. But the short answer is this, it is okay to mention other people's brand names as long as you're not creating confusion or there is reasonable foreseeability of confusion in the mind of the buyer that your product is someone else's product that you're posting on.

So if you're saying that, "Here is a box tissue and in this box of tissues, you could get a sticker". And put a sticker of Batman and this is a box of tissues with Batman sticker and you go elsewhere to get your Batman sticker then you put it on. Then you're just mentioning Batman, you're not selling Batman.

But if you will say, "This is Batman tissue box, please buy it!" then that would be passing off. So it's okay to say, "You can install that goes here, you can install that…" That's a functionality.

I know a vendor who even goes this far as to sell perfume and says, reminiscing of Britney Spears or alternative to Gucci or alternative to Armani.

As long as it is clear that it isn't that thing but it evokes that thing then generally you are okay. So you are allowed to do that. It's very simple.

You could say it would assist gamers. You could say the current trending games is this. You could use this for that game. Absolutely no problem with that.

Good thinking! Good marketing! It really just makes that connection for you.

Remember, that would be a restriction of the first page. You have to talk about the thing. You can't just say "I got my iPhone here. I can't go and create one for you". And say, "I'm selling you the iPhone which I own the rights." if you don't.

"Brendan, regarding sourcing agents, is there MOQ or preferred MOQ or minimum spend that you should be looking at when you engage the services of a sourcing agent?

Can I use them for smaller quantities when I just want to test the market or should I find my product myself initially test the market then once I'm done with my testing do I use a sourcing agent for larger quantities?

Does a sourcing agent deal in all types of products or only those that have a higher price per unit?"

Three great questions here.

So the first thing is the MOQ that the sourcing agent will need will the MOQ of the factory. That's it!

So the sourcing agent will be restricted by what the factory says. So they're just an agent. It's as if you have an agent that's you know buying a house for you. It's gonna be, you know how much the vendor wants to sell the highest price for.

"Can I use them for smaller quantities when I just want to test the market or should I find my product myself?"

You should use them for whenever you preferred to get an MOQ. That would be the answer to that.

"Does a sourcing agent deal in all types of products or only those that have a higher price per unit?"

They'll deal with all types of products as long as there is a higher overall price.

Remember, if you are doing a $500 order and let's say hypothetically agents charging 10%, you ask him to run around for $50. If it's $10,000 or higher and they are charging 10% then they are doing all this labour for $1000. Now you're talking!

So I would say that the minimum amount you would ask the sourcing agent really to procure would be $2000. Less than $200, there's really not much value in that order.

Less than $500 is no. More than $2000 yes.
