In today's podcast, we're going to cover one of the most common questions we get in our Amazon Seller Group. The question is "When listing a product on Amazon, can you get by using other people's brand names?".

Next is from Cate who asks about marketing,
"When listing your product on Amazon or eBay or any other website, can you get in trouble by using other people brand names? The context I mean is for example if you are selling a storage container, can you say for example that this is perfect for storing Barbie dolls in or Lego in and then also use a picture of your item with Barbies in it to show how it is perfect for that or the legos etc. Or by saying the product you are selling would be great to assist gamers and then using the name of a couple of specific, current, trending games in the title and marketing of your product. Can you leverage the marketing of your products off the current trends by using their names in your marketing without getting into trouble?"
That is an excellent question. So the actual would be, ask a lawyer is my official advice. But the short answer is this, it is okay to mention other people's brand names as long as you're not creating confusion or there is reasonable foreseeability of confusion in the mind of the buyer that your product is someone else's product that you're posting on.
So if you're saying that, "Here is a box tissue and in this box of tissues, you could get a sticker". And put a sticker of Batman and this is a box of tissues with Batman sticker and you go elsewhere to get your Batman sticker then you put it on. Then you're just mentioning Batman, you're not selling Batman.
But if you will say, "This is Batman tissue box, please buy it!" then that would be passing off. So it's okay to say, "You can install that goes here, you can install that…" That's a functionality.
I know a vendor who even goes this far as to sell perfume and says, reminiscing of Britney Spears or alternative to Gucci or alternative to Armani.
As long as it is clear that it isn't that thing but it evokes that thing then generally you are okay. So you are allowed to do that. It's very simple.
You could say it would assist gamers. You could say the current trending games is this. You could use this for that game. Absolutely no problem with that.
Good thinking! Good marketing! It really just makes that connection for you.
Remember, that would be a restriction of the first page. You have to talk about the thing. You can't just say "I got my iPhone here. I can't go and create one for you". And say, "I'm selling you the iPhone which I own the rights." if you don't.
