Breaking News: Republican Senators Propose to Overhaul the US Immigration System A group of Senate Republicans have released a proposal to overhaul the U.S. immigration system. The 4 main policy changes in it are as follows: 1. Border security: The proposal would renew construction of the border wall, boost retention for Border Patrol agents, and reimplement DNA testing at the border. 2. Asylum changes: The proposal would implement the "safe third country" rule, whereby migrants are ineligible for asylum if they transited through another country before showing up at the U.S. border. It would also strengthen the standard for what constitutes “credible fear” of persecution in the asylum seeker's home country. And migrants would be required to request asylum at a port of entry. 3. Parole changes: Parole would be limited to one year with the possibility of a one-year extension. The Department of Homeland Security also would no longer be able to use class-based criteria to grant humanitarian parole. And it would codify the Cuban Family Reunification Program and spousal and child reunification for active-duty military service members. 4. Remain in Mexico: The proposal would revive the highly effective “Remain in Mexico” policy that kept asylum seekers outside of the United States while their cases are being processed. And it would allow broader discretion for U.S. immigration officials to deny entry to other inadmissible aliens for the purpose of regaining operational control over the border. 3 WAYS TO STRUCTURE YOUR NEW U.S. BUSINESS If you'd like to establish a new U.S. business, here are 3 ways to structure it: 1. A Limited Liability Company (or "LLC") LLCs involve very few state regulations and separate your personal assets from your business assets and liabilities. They also trigger pass-through taxation, where profits of the LLC are taxed as self-employment income. And foreign owners of LLCs may be able to operate tax-free in the United States under certain circumstances. 2. C-Corp The C-corp is often a better structure for larger businesses and/or smaller ones seeking institutional venture capital. C-corps involve double taxation, however, because the business pays corporate tax and the individual shareholders pay income tax. 3. Non-Profit Non-profit organizations offer tax-exempt status because their profits are used to achieve a specific goal that benefits the general public. 3 U.S. VISA OPTIONS FOR INTERNATIONAL TRUCK DRIVERS Foreign-based truck drivers can deliver or pick up cargo in the stream of international commerce—that is, where the cargo is entering or leaving the United States. And they can do it with a B1 temporary business visitor visa. What they can't do with a B1 visa is pick up a shipment at one U.S. location and deliver it to another U.S. location. Fot that, they need a different type of visa. A TN visa won't work because tractor-trailor drivers aren't included as a qualifying profession in the United States-Mexico-Canada Agreement (or the "USMCA"). But trucking companies can apply for an E2 visa after making a substantial investment in a new or existing U.S. trucking enterprise. Or, if the foreign trucking company has or opens an affiliate in the United States, an L1 visa might work. 10 CRITERIA FOR AN EB-1 VISA You may be eligible for an EB1 visa and permanent residency in the United States without a job offer if you're an individual of extraordinary ability in the sciences, arts, education, business, or athletics, through sustained national or international acclaim. How do you prove it? Well, you must either provide evidence of a one-time major achievement (such as an Oscar, Pulitzer, or Olympic Medal) OR satisfy at least 3 of the following 10 criteria: 1. Receipt of lesser nationally or internationally recognized prizes or awards for excellence 2. Membership in associations in your field that require outstanding achievement of their members 3. Published material about you in professional or major trade publications or other major media 4. Service as a judge of the work of others in your industry 5. Original scientific, scholarly, artistic, athletic, or business-related contributions of major significance in your industry 6. Authorship of scholarly articles in professional or major trade publications or other major media 7. Display of your work at artistic exhibitions or showcases 8.
