  • Protecting the Fringe of Pop Culture: IP’s Role in Championing Outsiders and the Emerging Arts (with Éamon Chawke, Partner, Briffa law firm, UK & Ireland)

THANK YOU FOR LISTENING TO THIS PODCAST. WE VALUE OUR AUDIENCE. TO HELP US ENRICH YOUR EXPERIENCE, PLEASE COMPLETE THE FOLLOWING SHORT SURVEY: https://www.surveymonkey.com/r/BrandandNew

Intellectual property (IP) law is engineered to foster innovation and creativity. In some countries, the way IP applies to traditional forms of creativity such as music, painting, design, or even perfumes is understood and accepted. But, at least in principle, it may be less obvious when it comes to emerging popular forms of art, such as street and body art.

How does IP apply to street and body arts? Who owns what? What are the competing rights at stake—those of the owner of the building on which a graffiti is painted or the person bearing the tattoo? Beyond copyright, can trademark registration provide artists with additional protection? How does all of this play out on social media, the emerging arts’ favorite exhibition forum nowadays.

Éamon Chawke, a Partner with Briffa Solicitors, a boutique law firm in the United Kingdom, provides insight. Specializing in the protection, management, exploitation, and enforcement of IP, he has a broad spectrum of clients that include authors, agents, and publishers, as well as clothing, furniture, and graphic designers.

Every two weeks, on Tuesday, Brand & New gives the floor to inspiring individuals, with a 360-degree vision, to help brand owners, intellectual property lawyers, and marketing and finance professionals (and beyond!) stay curious and agile in an ever-evolving business environment.

  • The Gen Z "Brand Equation": Why ESG is so Critical to the Future of Brands (with Jeff Fromm, Youth Marketing and Trends Expert, FutureCast - Kansas City, Missouri, USA)

THANK YOU FOR LISTENING TO THIS PODCAST. WE VALUE OUR AUDIENCE . TO HELP US ENRICH YOUR EXPERIENCE, PLEASE COMPLETE THE FOLLOWING SHORT SURVEY: https://www.surveymonkey.com/r/BrandandNew

Born 1997 onward, Gen Z is  the world’s largest group of consumers, wielding hundreds of billions of U.S. dollars in spending power.  But whereas lots have been said about the previous generation, millennials, and their impact on marketing and branding strategies, especially online, Gen Z’ s preferences on brands are now under scrutiny, including in a major study launched by the INTA.

On track to be the most educated generation yet, Gen Z seem to have strong opinions and values and want to be heard. What does it mean for brands? How can they engage with f this generation? How is this generation reshaping the messages conveyed by brands, particularly referring to environmental, social, and corporate governance (ESG)?

Our guest today, Jeff Fromm, is a renowned youth marketing and trends expert and speaker on consumer trends, brand strategy, and innovation. He was a pioneer in researching millennials and Gen Z from a marketing perspective, by leading the first large, public-facing study on the topic with the Boston Consulting Group 10 years ago.

With over 25 years of experience in marketing across a wide variety of brands, Jeff is the President of the think tank FutureCast, and a partner at Barkley, based in the U.S.S. He is also a contributing writer for Forbes and author of four books: Marketing to Millennials, Millennials with Kids, Marketing to Gen Z, and The Purpose Advantage.

  • When the Business Model Makes the Brand: Pacari Chocolate's Case Study (with Santiago Peralta, Co-Founder & CEO - posted initially in October 2019)

There are multiple stories about entrepreneurs who beats the odds and launch their own companies and successful brands. They are a source of inspiration, showing how they made their own marks in doing business distinct from everybody else.
Think of a food company that decided to build its whole business model on fair trade and inclusion, the statement that represents its brand identity. This is the story of Santiago Peralta, the cofounder of Pacari Chocolate based in Quito, Ecuador. His company, created in 2002, has changed, not to say revolutionized, the chocolate industry, promoting new strategies and values hand in hand with more than 3,000 families of farmers, creating schools for sustainable agriculture, and developing organic certification processes. With transparency, social responsibility at the very heart of the business model, Santiago will explain how these ethics have shaped the brand, which is now distributed in more than 40 countries and has received more than 300 awards and medals as one of the most premium chocolates in the world.

  • The Impact of the Video Conferencing and Social Media Apps Boom (with Dominique Shelton Leipzig, Perkins Coie LLP, Los Angeles, California, USA)

Video conferencing and social media apps like Zoom, Houseparty, and TikTok have exploded in popularity during these times of global social distancing. While these apps have become much more popular among regular users, they also have attracted potential hackers, raising opportunities as well as risks to a brand-new scale and prompting some platforms to institute stronger security features.

Will this surge in usage have a lasting impact on these companies in terms of value, brand reputation, diversification of services, available security features, or even future privacy regulations?

In this episode, we discuss these issues with Dominique Shelton Leipzig, a partner in the Privacy & Data Security Group and co-chair of the Ad Tech Privacy & Data Management team at Perkins Cole LLP, Los Angeles, California, USA. Practicing intellectual property, media, and privacy law for over 25 years, she is a member of the board of the International Association of Privacy Professionals and the author of two landmark books on privacy and data for businesses.

  • The New Pirates: Innovative Options to Tackle Counterfeiting in China (with Loke Khoon Tan, Partner, Baker & McKenzie - posted initially in May 2019)

Welcome to this special episode of Brand&New in Boston, Massachusetts recorded during INTA’s 2019 Annual Meeting. This unique event, a must for education and networking, is attended each spring by more than 10,000 members of the IP community and beyond, from over 150 countries. So Brand&New could not miss it!

Counterfeiting is no less than one of the biggest issues of our times. It is self-evident to say that it is linked to crimes, that it costs billions to companies and societies every year in all areas. So relevant actions are more essential than ever, particularly to tackle illicit sales.  Our episode today is about the most efficient ways, with the development of innovative tools, to fight these new pirates.  Our focus will be China, and its challenges about IP, including the impact of so-called trade war with the US.

Our guest is partner at one of the largest law firms in the world, Baker & McKenzie, present in more than 40 countries. Loke Khoon Tan leads the IP Practice Group in Hong Kong and China and co-leads the firm’s luxury and fashion industry practice.  He works with global brands, helping them to structure and implement anti-counterfeiting strategies. Loke is the author of the “Pirates” trilogy and other publications about IP protection. So who else to talk about this hot topic?

  • Acting With Purpose: Brands & Social Justice (with Peter Golder, Professor of Marketing, Tuck School of Business-Dartmouth College, Hanover, New Hampshire, USA)

Following the recent wave of protests around the world centering on racial injustice and police brutality, many brands using offensive racial stereotypes have taken a stance, either voluntarily or due to social pressure.

In the United States, in particular, consumers and media organizations have pinpointed brands like Uncle Ben’s, Aunt Jemima, and the Washington Redskins*, demanding changes or even removal of their iconic yet questionable logos. Many brands also have publicly spoken out on these social tensions, or decided to proactively change their branding strategy or even product offerings.

What are the risks when brands get involved in social issues, and how can the effectiveness of their reactions be assessed, especially in terms of consumer perception?

To discuss these issues, Brand & New welcomes Peter N. Golder, Professor of Marketing and the Faculty Director of the Tuck School of Business at Dartmouth College, in Hanover, New Hampshire. Professor Golder has been teaching at Tuck for more than a decade. The winner of many prestigious awards in marketing research, he focuses on market entry timing, new products, long-term market leadership, branding, and quality. He has won many prestigious awards in the marketing research field and was published in media such as The Economist, The Wall Street Journal and The Financial Times.
*Note: A few months ago, Uncle Ben's and Aunt Jemima each announced that they soon will be changing their name and image on their packaging; and the Washington Redskins changed its name to the Washington Football Team.

  • TOMS Shoes: Standing for Tomorrow, the Case Study of a Trailblazing Brand (with Jessica Murray, Senior IP & CSR Director, Toms Shoes Inc. - posted initially on November 2019)

Many brands publicly support good causes, but it’s much less common for brands to build their core identity on the idea of "giving back." That is what makes the TOMS brand pretty unique, as its message, offer, and customer base were all from the outset based on philanthropic principles, notably with their famous “One for One”  shoe-giving program. What made — and still makes — TOMS' brand strategy and implementation successful? What does innovation mean for a brand like TOMS, notably in terms of marketing and audience engagement, and in terms of corporate social responsibility (CSR) initiatives? And what are the legal challenges associated with these new ways of interacting with actual and potential clients?
In this episode initially posted in November 2019, we discuss TOMS’ innovative brand strategy with Jessica Murray, Senior CSR and IP Director at TOMS Shoes Inc., based in Los Angeles, California With TOMS since 2013, she has spent her career protecting brands across various sectors such as luxury goods and hospitality. She shares with us her perspective on brand enforcement, and more specifically how to foster consumer loyalty through meaningful principles and genuine commitment to social causes.

  • The Virtual Work Order: Generate Higher Performance and Stronger Relationships (with Keith Ferrazzi, Ferrazzi Greenlight, CEO)

Our social lives have been turned upside down over the last six months, to say the least. While we have all appreciated first-hand the consequences of the COVID-19 pandemic on our personal life, it has also impacted our professional relationships and daily interactions. Remote work seems to be here to stay with an estimated close to 30% of the workforce working at home multiple days-week by the end of 2021.

How to overcome the challenges due to remote working when it comes to building, entertaining, and thriving through our professional relationships? How to leverage technologies, without too much trade-off in terms of authenticity and true connection? How to remain engaged and present when most interactions remain remote?

Just a few weeks before the International Trademark Association’s first-ever virtual Annual Meeting & Leadership Meeting, scheduled for November 9 to 20, 2020, who better to discuss these topics than Keith Ferrazzi, entrepreneur, TED Talk speaker, and author of the best sellers Never Eat Alone and Who's Got Your Back? as well as Leading Without Authority, recently published and the website goforwardtowork.com, for the future of work. Keith is a frequent contributor at publications such as Forbes, The New York Times, The Wall Street Journal, Fast Company, among many others. He has also been at the forefront of remote team transitions with his research, available on the website virtualteamswin.com, that also appeared in Harvard Business Review.

As the founder and CEO of the strategic consulting firm Ferrazzi Greenlight, based in Los Angeles, California, USA, Keith has been focusing on the importance of positive relationships to reach business success, addressing the behavioral issues that block organizations from reaching their goals. His previous experiences as chief marketing officer of the global hospitality company Starwood, have also contributed to build his vision on success redefinition, on the ways to Co-Elevate® to innovate and to team out to bring in the right expertise and “go higher together”. His insights shall be eye-opening for intellectual property and legal teams, and beyond.
