Duncan heads up Gazeal Limited, a company leading the way on reservation agreements.  Duncan reminds us that around 33% (Yes!  33%!) of conveyancing transactions fall through before exchange.  It is this frightening statistic which made Duncan think that there must be a better way for sellers and buyers to have certainty and peace of mind and this led him to develop the Gazeal reservation agreement.
We discuss the benefit of the agreement for conveyancers and their clients and along the way chat about how Duncan went from litigating in Cambridge to running a prop tech company and his views on the state of the conveyancing market.

The conveyancing market has boomed with the pent-up demand from lockdown and the announcement of the SDLT holiday.  In this Conveyancing Matters chat, Lorraine and Stu talk about some of the reasons for the delays which conveyancers and their seller and buyer clients are experiencing.

In this Conveyancing Matters chat, Lorraine and Stu give themselves a right of reply! Stu has some files in his office which can be seen by our lovely viewers, and a Conveyancing Matters viewer simply assumed this meant that Stu’s firm uses paper files.  Nothing could be further from the truth – but in this video, Lorraine and Stu chat about the ‘paper vs digital’ files argument.  As Stu says, there is an assumption that paperless is the better route to communication – but is this necessarily the case? And as conveyancers still have to deal with unregistered titles and have to keep files for many years to comply with regulatory requirements, going completely paperless is not always as easy as it seems.  Stu also rather mysteriously mentions an old car that he owns – we will try to find out about that in another Conveyancing Matters chat!

Just as we came out of lockdown, the Chancellor announced the SDLT holiday – meaning that, for most, there is no SDLT to pay on a property priced up to £500000 until 31.03.21. This was intended to be a boost for the property market. But is it all it’s cracked up to be?  Is the measure even necessary as the market was picking up strongly after lockdown eased? Russell Quirk has ignited an age-old argument – conveyancers are too slow and conveyancing should be a ‘one stop shop’ under the roof of the…. estate agent!  Russell’s view is interesting and provocative, and Lorraine and Stu could not let this one lie! In this Conveyancing Matters they challenge some of Russell’s views (and invite him for a discussion if he would like one!) – and point out the day to day realities of running a conveyancing practice.  A conveyancing client is not a ‘consumer’ for a law firm and this distinction is important.  Also, agents and conveyancers tried to do it all under one roof 30 years ago – it didn’t work then, so why would it now? HMLR has announced that from 27.07.2020 it will accept for registration documents that have been signed by electronic means.  A great day for conveyancers, surely?  In another Conveyancing Matters chat, Lorraine and Stu discuss this ‘hot off the press’ announcement. Lorraine prefers face to face meetings and witnessing signatures in person.  It’s her age, probably.  Stu heads up a large tech enabled conveyancing practice – so he will view e-signatures differently.  Right?  Well, not necessarily.
