Heren Brian provides a few tips on handling Public Student Loan debt collections. While the options are limited with public or government student loans, with the resumption of student loan payments happening after three years in covid forbearance, new servicers and collectors will show up at your door and might try to get more money from you than you owe so that the corporation can make up for the three-year loss of your payments and interest.  Brian gives a brief overview of a special validation letter to send and the reasons why it could help you from being ripped off.  See the letter on Podcast + in a section titled, Public Student Loan Help. Look also for a credit dispute letter to send if a new company hits your credit without proof, they have a right to pursue you. Again, if the letters they send you have a mini-Miranda warning ("we are debt collectors") on them and claim to be debt collectors, collecting a debt, use the Fair Debt Collection Practices Act to fight back. Using the Full Demand provision of the student's contract they claimed to have purchased from BOA, the resurrect the Statute of Limitations and sue the debtor years after the debt has died. He explains further that less is more, especially when you have to file a motion to compel when the other side fails to properly answer the questions.  Brian also takes you the through the type of discovery to send, why an opposing party responds the way they do (generally not a good reason) and how to turn evasiveness into a win for your side. In this video, Brian reviews SoloSuit.com's video that encourages people to file a Motion to Compel Arbitration.  Brian's experience tells him and you that the SoloSuit advice is rotten and can cause you damage and put you in greater jeopardy than if you stayed with the court system. Ironically, Solo Suit's front man George Simons' advice to arbitrate and not go to court where he claims you will likely lose and have to pay the debt collecotr attorney fees to the debt collector, flies in the face of their main business: Selling people Answer documents to be in the court he claims you will lose in if you go there. Brian breaks down all the false information in the Solo Suit video and showing you that the Solo Suit video pushing Arbitration offers no help to guide you through process or how to win. Nothing. Caveat Emptor when using SoloSuit.

Brian reviews a video by SoloSuit.com's ( @solosuit ) owner, George Simmons titled "Six Tips for Drafting the Answer in a Debt Collection lawsuit" to see if it matches up to Michigan law or if any of the tips work. The Solo Suit video gives out bad advice based upon completely wrong information and if a consumer follows the SoloSuit instructions, it could potentially cause a Michigan consumer greater harm and damages. In Brian's opinion and after 30 years of practicing law for Michigan and Florida consumers, the Solo Suit video should be titled, "Solo Suit's Six Tips on how to lose a Debt Collection lawsuit in Michigan." Caveat Emptor when paying for something like this.
