It's Creditor Defense Week and Brian shows you how you might want to come right in on creditor cases with the securitization defenses which really emphasize that there are missing assignments to and from the secured trust such that the creditor can't have Standing To Sue you without those assignments. Notice also that creditor lawsuits don't actually say the would "debt" in them but replace it with the word "account." Cause they are not suing you for the debt but just the rights to an accounting of the amount owed. Look up the definitions of "account" and "debt" and see that the "debt" is long gone. Good luck fighting the bad guys.

Here, Brian finishes up his supplement series on "securitization as a defense" with debt buyer and "fintech" cases. The securitization of debt, while good for the economy, is bad for debt buyers and collectors as with the fintech model of personal loan financing, there are many owners or assignees of the original debt. Mostly weird sounding secured trusts claim ownership but with no proof. Which is a problem for the debt buyer which has to show all assignments or owner Bill of Sales to prove they own the debt they sue you upon. This new pretzel litigation of ownership is another way to show that the company suing you has no standing or the right to sue you. Good viewing and good luck.

In this video Brian introduces you to a supplement to his other videos on "securitization as a defense" to collection lawsuits. Here, you will see how to handle two types of lawsuits from creditors with securitization as they relate to the ownership of the debt you are being sued on. Generally, the creditor does not own the debt without proof of an assignment from the secured trust back to the original creditor (Creditor suing you) after the default on the creditor obligation. In short, these creditors don't have standing to sue you without proof they got back whatever they sold to the securitized trust. Good and quick analysis to the previous videos and on a whiteboard for better understanding.

In this video, Brian helps you understand why judges do what they do and how to handle them if you sense there is a bias against you. The video explains what motivates judges and provides you with five tips to use in court. The key is to stay on message and focus on the debt collector as the bad guy with one of the tips being a fun and cool approach: Never stop referring to the other side as a "debt collector." Remind the court that you live in the same district the judge does and vote and that the debt collector is from out of town and not of any value to the judge getting re-elected. You are not there to come in second. Keep the respect for the court but don't be a doormat. You are a voter and deserve respect too. Good luck.
