In last week’s podcast episode, we looked specifically at what happens if you’re unfairly dismissed, but you have also done something to contribute to your own dismissal.  This week’s podcast looks at what happens if you are dismissed from your job for misconduct or gross misconduct, but you believe your employer may have over-egged the issue and made an incident much bigger than it actually is, just to sack you from your job.  In the podcast, we look at the role of employment tribunals, in putting employers to the test regarding the reasonableness of employer’s belief, about the guilt of employees who are facing allegations of misconduct that could lead to the employee’s dismissal.

Hi there

This week, we are completing our look at procedurally unfair dismissals, to look at the other side of the dismissal, where the conduct of your employer might have been procedurally wrong, making your dismissal unfair. But, where the tribunal still thinks you have some responsibility for your own dismissal, and you should be held accountable for that responsibility.

This is called contributory fault and the tribunal will be looking at whether you contributed to your own dismissal, which led to your unfair dismissal. 

In this episode, we go through the definition of ‘contributory fault’ and we look at the original legal precedent case, that put ‘contributory fault’ onto the statute books.

This week we move into the most controversial areas of dismissals, which are unfair dismissals that are procedurally unfair.

Procedurally unfair dismissals can be controversial because even if you behaved badly at work and then you are sacked, your dismissal could still be unfair if your employer did not follow a fair dismissal procedure. 

We take a look at the reasons for this and look at an employment tribunal case to give you a view of why tribunals will focus on the fairness of procedures as part of unfair dismissal cases.

Having just spent the last two episodes looking at the impact of the new covid law on your employment rights, this week, we get back to looking at your rights around unfair dismissals.  It’s important that we do this because there are bound to be dismissals that occur because of the new covid law, which some employees will feel, are unfair dismissals. So, knowing some of the steps you can take to at least begin to ask questions can be a helpful route for you.

We hope your employment rights are working to look at the recent changes in the law, which mean that a ‘no jab-no job’ rule may be coming to a workplace near you. 

The law on care homes and covid vaccinations was changed on 30th July 2021 and you are now required to be fully vaccinated before you enter a care home that provides personal or nursing care to its clients.

This is the first of a two-part series looking at this issue.
