Episode 16 is in the books and is one of our best ones yet. In this edition of End Scene: An Entertainment Law Podcast, Evan and Tony discuss a bevy of interesting Entertainment Law topics. We weigh in on whether we think “Taco Tuesday” should be considered a generic mark (03:37). In the same vein, we discuss a lawsuit that is slated to be discussed in the Supreme Court regarding Donald Trump and whether the phrase “Trump Too Small” is a trademark-able phrase (10:09). Then, Evan and Tony discuss the new Broadway show “Here Lies Love,” which begins previews this month (16:06). The show is already under fire for a ton of guild-related issues, including the non-use of a live orchestra. We discuss this new show and the Tony’s in light of the WGA strike and give a brief update on SAG-AFTRA and DGA (24:42). Additionally, Evan and Tony discuss Shannon Sharpe’s departure from FS1’s “Undisputed” with co-host Skip Bayless (27:57). What does this departure mean from a contractual standpoint and what will become of “Unc’s” Podcast? Lastly, Evan and Tony give a box office update from their draft and share their favorite board game, in light of the new Transformers movie hitting theaters this weekend (37:19).

A new week calls for a new episode of "End Scene!" In Episode 14, Evan and Tony recap the outstanding cases that were discussed in previous episodes that didn’t have a resolution when the episode aired (03:13). In light of the live-action remake of “The Little Mermaid,” Evan and Tony discuss contract formation and whether Ursula's contract with Ariel was valid and/or voidable (11:05). Episode 12 is here and Tony and Evan reunite to provide their commentary after two consecutive episodes with guests! This week, Tony and Evan dive into the copyright infringement lawsuit from the Ed Townsend Estate against Ed Sheeran, in which the Townsend Estate alleges that Sheeran's "Thinking Out Loud" directly infringes on the copyright of Marvin Gaye's "Let's Get It On," which Townsend co-wrote (04:11). (Editor's note: shortly after Episode 12 was recorded, the jury in the Ed Sheeran copyright infringement lawsuit found Ed Sheeran NOT LIABLE for copyright infringement.) Later, Evan and Tony talk about the Apple TV+ series "Schmigadoon" and how it's legally possible for Cinco Paul and the writers of "Schmigadoon" to make the music for the show sound nearly identical to major Broadway musical numbers (17:37). Was the music in "Schmigadoon" created under fair use? Or was the underlying musical composition to major Broadway musical songs licensed by way of a mechanical license agreement? Tony and Evan break it all down. Then, Tony and Evan share the latest details of the Writers Guild of America's strike after collective bargaining talks with the Alliance of Motion Picture and Television Producers came to a halt on May 1, 2023 (32:38). Finally, in light of Star Wars Day on May 4th, Tony and Evan wrap up the episode with their favorite Star Wars memory (43:23).

Tony, Evan, and Ian discuss indecency, censorship, and how George Carlin's "7 Dirty Words" bit propelled into one of the most important Supreme Court cases on regulating free speech in America (3:40). Later, Ian discusses parody under the First Amendment and how a fight between conservative evangelist Jerry Falwell and American pornographic publisher Larry Flynt laid the groundwork for parody and free speech (30:45). Shifting into current events topics, Tony and Evan chat with Ian about the defamation lawsuit between Dominion Voting Systems and Fox News that led to an INCREDIBLE $787 million settlement for Dominion (38:22) and the US government's threat to ban TikTok (47:18). Finally, Tony, Evan, and Ian all share their favorite childhood movie from the decade that they were born in (55:24).

Episode 7 is here and while Evan is in Florida and Tony suffers from separation anxiety in NYC, the fellas deep dive into a treasure trove of entertainment law stories from the week! First, Evan and Tony and share details of the negligence lawsuit against Gwyneth Paltrow over a ski accident (03:29) and they even shared their thoughts on the verdict, which happened at the time of their recording! Then, Tony and Evan discuss the troubling news and all available details involving Jonathan Majors' arrest for allegedly hitting his girlfriend and causing a laceration behind her ear and bruising as a result of a fight (12:49). The arrest and charges against Majors even led to the US Army pulling ads that featured Majors, a move that is consistent with Tony and Evan's discussion about morals clauses that was shared a few weeks ago. Finally, ever wondered how many players are involved in a single IP franchise? In light of the success of the hit Amazon Prime show "Daisy Jones & The Six," there are rumors that the band in the show may go on a US tour! This news gave Tony and Evan the "prime" opportunity to talk about all the IP and copyright owners that are invested in this singular franchise (20:55). And lastly (29:10), Tony and Evan play a fun game a la fantasy sports draft style and each pick the 5 movies that they think will generate the highest box office numbers of 2023!
