Also, who can be counted for the eruv techumin as "homeowners," rather than a shopkeeper. But even a "kli," a vessel or utensil, would work with a shopkeeper too. Similarly, one who said "make me an eruv" would work with the shopkeeper too. ie - the original case is a problem and wouldn't work without a formal act of acquisition, but there are modifications to the original case that make it effective in establishing an eruv.
