Earlier this month, the Federal Court ruled on Hamilton Beach Brands, Inc. v. Sunbeam Prods., Inc., a case focused on Hamilton Beach's slow cooker appliance. The Court found the patent invalid because Hamilton Beach's supplier, in response to a purchase order by Hamilton Beach itself, offered to sell the company a version of the product over a year before a patent application had been filed. Finnegan attorney Eric Raciti joins us now to discuss the lessons in this case for companies using OEM suppliers under the old U.S. patent laws, and also a potential wrinkle in the future under the new America Invents Act.
