Ramaphosa’s legal team, led by Wim Trengove SC, argues that the panel applied the wrong legal test when it found sufficient evidence to justify an impeachment inquiry and failed to properly assess the President’s version of events.
The ATM, EFF and MK Party are opposing the review, although they each put forward different arguments about the role of the courts and Parliament in the impeachment process.
With the Constitutional Court having revived the process and public hearings currently halted by the High Court, Tara explains the key legal arguments and what the court’s decision could mean for the future of the Phala Phala inquiry.
