Initial Hearing and Pretrial ConferencesYou may be concerned about your future if you have been charged with a criminal offense in Indiana. As you prepare to defend yourself in court, it's critical to know what to expect from the pre-trial process so you can be more prepared.
What to Expect During the Indiana Pretrial ProcessA pretrial conference is held to determine if there are any motions that need to be ruled on, make sure the prosecutor and the defense attorney have exchanged appropriate documents, and basically make sure that everyone is on track for the trial. Many times pretrial conferences are handled by conference calls; however, some judges require a formal pretrial conference at which the defendant is required to appear. The victim does not need to appear.
As a result, you should choose an attorney who is willing to involve you in the pretrial process at every stage. With that in mind, here's a general outline of what to expect throughout the Indiana pretrial phase.

You might be able to ask the court to issue you a protective order (sometimes called a restraining order) against your abuser or stalker depending on your specific situation. This could also provide the police with enough information to make an arrest and the prosecutor with enough evidence to file charges, which could result in a no-contact order, an additional kind of protection.

Attorney Mark Nicholson and Attorney Audrey Lunsford discuss the trial process. What Are the Steps for a Criminal Jury Trial? If you are charged with a crime and have a jury trial, you might wonder what the steps are. The process starts when the prosecution and defense teams present their cases. The court clerk will call groups of prospective jurors for voir dire. The judge will also ask each potential juror to answer questions that will help them decide if they are impartial. A judge will explain the legal standard based on the charges and evidence. Once a jury has been selected, they will be instructed by the judge to decide the case.
The parties give opening statements, direct examination and cross-examination of witnesses, then closing arguments. After the closing arguments, the judge will give the jury instructions. These instructions will describe the issues at stake in the case, the positions of the parties, and the applicable laws. The judge will also explain the standard of proof for the case again, which may be beyond a reasonable doubt in a criminal case or a preponderance of the evidence in a civil case. The jury will then decide based on the presented facts.

Qualified Immunity: How Does It Work?
One case that highlights both the absurdity of qualified immunity and the extent to which officials may go under its protection is Black Lives Matter D.C. V. Trump, the ACLU-DC’s class-action lawsuit challenging the vicious and unprovoked attack on civil rights demonstrators in Lafayette Square on June 1, 2020.
The defendants in the case were sued under Section 1983 and Bivens, which is another type of case where officers can use qualified immunity. From the Park Police officer who beat a journalist as she was escaping the protest, all the way to former Attorney General Bill Barr, they all invoked qualified immunity to avoid liability for their misconduct.
