Is there a case against the employer if the employee is intoxicated 😵‍💫 It's a tricky one. There is no case against the employer directly 🫵 There'd be a workers compensation case potentially, even if you may slip and fall at work and you're on your way into your work, you still have worker's compensation claim 🤝 It's kind of a weird thing, but you do have a case. However, IF, alcohol in his blood and it's over 0.08 they can make that argument that he was intoxicated. That might neutralize that worker's compensation case. If it's below that 0.08 marker, or around if there's an argument that he was not intoxicated, it was just from the night before. It's gonna be an argument. It's gonna be one of those things where it's gonna be a judgment call by the judge. I was in trial one time and the craziest thing happened 🤯 So, we were putting on our testimony when it comes to our medical expert. So, we had done a deposition and then we had recorded it so we were planning a video for the jury. Lights were out, and we had a big screen TV in there and the jury was watching it 🍿 And I hear snoring 😴 I'm like, what the hell's that? And it gets louder and I look over and it's my client 👀 My client's sitting straight up and just snoring as loud as can be 🤦‍♂️ I'm having to kick my client's chair to wake him up before the jurors noticed. And luckily by the time the jury looked over, they didn't know who it was cuz he had woken up and kind of snapped out of it 😆 Luckily he wasn't slobbering or anything. But one of the craziest moments I've experienced when it comes to a jury trial, when it comes to a client falling asleep, it was kind of a silly situation. Let me tell you about one of the dumbest things I've ever experienced 🤦‍♂️ I was in court in front of a judge one time and the client said one of the stupidest things you could say during the sentencing hearing. I had a very clear conversation with my client beforehand. This was a case where she had hurt another individual and the victim was there. The victim had given a statement in open court, and I said: "You need to stand up, you need to apologize to the judge, and you need to apologize to the victim. Look right at them and say how sorry you are. That's all you need to say." What proceeded to happen after that? She stands up and instead of apologizing, she instead starts to explain to the judge and to the victim, how she had basically become the victim by all of this and how it's affected her when it comes to her work life, her family, and not apologizing one time to the victim or to the judge 🤦‍♂️ And so, what the judge did at that time was she said: "Okay, Mrs. such and such. Your attorney worked out a really good agreement for you here. That agreement is something I'm no longer going to accept." She ended up giving her triple the jail time as to what she was. I don't think I've experienced a funnier trial in my life, I'll never forget it 😆 I was in trial one time, and it was at the very beginning of the case. We get up, we give our opening statement, and then the defense attorney gets up and starts giving his opening statement 🗣 He's about three minutes in and we're like, wait a sec, what's he talking about? He starts talking about how our client, even though he was claiming that he was severely injured, he started explaining all these things that happened and it was the wrong case 🤦‍♂️ He was giving the wrong opening statement for his case. We had to stand up really quick, so we couldn't figure out, we're like, maybe there's something we don't know about it, and we finally put all the pieces of the puzzle together 🧩 So, we objected. We went up to the sidebar with the judge and say, "Judge, we don't know what he's talking about. This isn't our case. He's given an opening statement. It's the wrong case." And the attorney went back and looked at his file and he realized he had the wrong opening statement. Instead of asking for a mistrial like we would normally on this one, we felt this actually kind of benefits us, but the judge just advised the jury to disregard his entire opening statement, and he had to see it up and give a new opening statement, which I'm sure was extremely difficult and embarrassing for him 😬 Still to this day the funniest trial mishap I've seen. Law school exams can be really weird 🥴 Most people don't realize this, but you'll spend your entire semester studying a specific topic. So, for example, let's say it's evidence, or let's say it's civil procedure or TORTS or criminal law 🦹‍♀️ Those are all the major topics that you're definitely gonna cover, and there's more. You'll spend the entire semester every day reading about those topics, and you have zero idea how well you're doing because you don't get graded until the end on one exam 🧐 Most law schools, you have one exam to get it right, that's it. And so it's very nerve wracking and it forces you to really lock in and make sure you know your stuff. So it's an effective way of doing it, but it's also very nerve wracking because you really have no idea how well you're doing when it comes to compare yourself to classmates ✏️ And, you take that exam two-three hours later, you walk out and then you gotta wait a couple weeks and you find out what your results are 😓 It can be pretty stressful.
