In this episode, we discuss the recent trial of the McMichaels, for the murder of Ahmaud Arbery, and the importance of jury instructions in a trial. We will focus on the judge's instructions to the jury on citizen's arrest.
A major issue of the case was the statute for citizen's arrest - which is ambiguous or confusing. Instead of giving a jury instruction on this area of law, the judge simply read the statute itself.
