Title IX is complex, and recent proposed regulations and the ongoing lawsuits have only added to the confusion. Schools are now faced with the challenge of deciphering a maze of court rulings to understand their obligations under both state and federal law. And if that wasn’t complicated enough, special education considerations further complicate compliance.
In this episode, Jeremy and Erin delve into a notable case from Oklahoma that highlights critical missteps to avoid when addressing allegations of sexual harassment, regardless of which version of the Title IX regulations your district follows. They also explore the proposed changes to Title IX that will directly impact students with disabilities and share practical advice for IEP teams to avoid potential liability under both Title IX and the IDEA.
UPDATE: On August 16, 2024, subsequent to the recording of this episode, the United States Supreme Court ruled 5 to 4 to allow injunctions in effect in 26 states to remain. The U.S. Department of Education had asked the Court to lift the injunctions on the grounds that they were overly broad.
